Hello! this is not the first time i am posting something on here, but i feel like this is the only place where i can get help and advice, so please don't judge me.

I have been married for about 10 months and got my green card just a little over 2 months ago. My husband will file for divorce this week. Our marriage is very hard. It just can't go on anymore. He also wants me to move out asap. I have no money at all, no car, no friends. I would like to get some opinions as for my situation.

Is there any chance for me to keep the green card (it was a good faith marriage)?

what should i do if he doesn't let me get the evidence of our marriage?

how to apply for waiver of the joint petition?(and does it even make sense for me to do that)

and maybe just some opinions on what i should do. i am so exhausted from all that, i'm on the edge. this is the worst nightmare of my life. please help!

As soon you have the divorce decree you can file the I-751 waiver and your husband won't sign. YOU need to have proof of a bonafide marriage otherwise Uscis wont renew your GC. Get all proof right now,some of them you can get online such as Irs transcript,Bank statement,most of the utilities bills.If you don't have joint bank account,joint tax return,lease agreement in your name and utilities bills in name of both then you have a HUGE problem.

Since you have a green card, that means your husband filed an I-864. Even after your divorce, he is still responsible for you. Divorce would not abrogate that contract he has with the US government. You should be consulting a divorce attorney familiar with immigration cases to secure and protect everything to which you are entitled. It sounds like he is being abusive. You want to document that as much as possible, and contact local authorities if he becomes physically abusive.

I was in the exact same boat as you ...my marraige broke but i fought for it on my own and got my 10 year one ...

how did u have your green card before you divorced? I would appreciate if you share your experience with me!!!! I was wondering if it is even possible in my case. I haven't been married for too long and i honestly would like to stay to try to make out relationship work. i still love my husband

Same as you I bet as it is a reference to the 2 year GC and she faught to get her 10 year GC after the divorce. You have a GC now, it is just that you have to renew it in 2 years after issue if still married or immediately after divorcing the spouse you gained the GC thru. The hardest part will be provding proof that the marriage was entered into in good faith. Your husband is still on the hook for the I-864 so you can get means tested benefits and he will have to repay the government. If he gets physically abusive, get out of there and make certain you document the abuse. You can try to save the marriage, but he must be wilingl to stay in it as well.
