Today he basically told the supreme court, even though you found Arizona law constitutional, guess what? I will not enforce it.

I don't care where you stand on immigration, if you are a liberty loving American you should be beyond angry that our President has shreeded the constuion and is refusing to enforce the laws of this nation, despite the states pleas for help.

Not exactly correct. A majority in both the house and senate voted in favor. A republican FILIBUSTER in the senate killed it, against the wishes of a majority in congress!

The President has had deferred action powers since 1992. All he can really do is grant a stay on deportation, which does not grant permanent residency or citizenship. Like it or not, the Legislative branch is the one who gave him this power.

The Supreme Court is interestingly still majority conservative, but at least not all of them are nuts like you. The Constitution is the reason why most of the Arizona law was struck down.

You're missing the point. The Supreme Court upheld the authority of Arizona law enforcement officers to question people they had lawful contact with about their immigration status if they had a reasonable suspicion that person might not be lawfully present in the United States. Within hours of the Supreme Court decision the Department of Homeland Security announced they were suspending the 287(g) program in Arizona - a program that had 1400+ law enforcement officers in Arizona trained to cooperate with the federal government in enforcing immigration laws. DHS also ordered ICE and CBP to NOT accept any illegal aliens apprehended by Arizona law enforcement officers unless those aliens were part of a group DHS said they were focusing on - aliens with criminal convictions, aliens with multiple unlawful entries, and aliens who had recently entered unlawfully.

In other words, the Supreme Court decision said that Arizona can catch illegal aliens, but they can't jail them because Arizona doesn't have the authority to criminalize immigration law violations. The only thing they can do with them is turn them over to federal law enforcement. The Obama administration responded by saying they won't accept them from Arizona law enforcement unless they fit their narrow criteria. Obama turned a mixed decision into a clean sweep by fiat.

Justice Scalia is fuming mad about this. Even before DHS announced they would no longer be cooperating with Arizona, Justice Scalia wrote a scathing rebuke of the administration in his dissenting opinion, accusing the administration of refusing to enforce the law for political gain.

Justice Scalia:

It has become clear that federal enforcement priorities—in the sense of priorities based on the need to allocate “scarce enforcement resources”—is not the problem here. After this case was argued and while it was under consideration, the Secretary of Homeland Security announced a program exempting from immigration enforcement some 1.4 million illegal immigrants under the age of 30.

[For certain illegal immigrants] immigration officials have been directed to “defe[r] action” against such individual “for a period of two years, subject to renewal.” The husbanding of scarce enforcement resources can hardly be the justification for this, since the considerable administrative cost of conduct­ing as many as 1.4 million background checks, and ruling on the biennial requests for dispensation that the nonenforcement program envisions, will necessarily be deducted from immigration enforcement. The President said at a news conference that the new program is “the right thing to do” in light of Congress’s failure to pass the Administration’s proposed revision of the Immigration Act. Perhaps it is, though Arizona may not think so. But to say, as the Court does, that Arizona contradicts federal law by enforcing applications of the Immigration Act that the President declines to enforce boggles the mind.

Remember that Justice Scalia wrote this BEFORE DHS announced they were suspending cooperation with the State of Arizona, and would be refusing to accept illegal aliens apprehended in Arizona.

I don't know if the Supreme Court has ever found an administration in contempt, but this administration certainly deserves such a finding.

I don't know if the Supreme Court has ever found an administration in contempt, but this administration certainly deserves such a finding.

I wonder if Scalia has an opinion on the GOP senate members who "misused" the filibuster at an unprecedented rate in an attempt to prevent any legislation from passing at all. If legislators had not outright refused to legislate, we wouldn't even have many of these cases in front of the supreme court to begin with.
