Not without a conviction. Even then, only if DHS decides to initiate removal proceedings. Some jurisdictions refuse to refer someone to DHS unless they are unlawfully present. Some other jurisdictions refuse to refer anyone to DHS, regardless. At this point, DHS is reluctant to initiate removal proceedings against anyone who doesn't have a criminal conviction, or hasn't entered multiple times without inspection, or hasn't recently entered without inspection. It's an election year and Obama needs Hispanic votes.
