Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hello, can I use profit from the sale of a house that is given to me in a divorce as an asset for the I-864 form?

Thanks Penguin, you always help me out!! I have a copy of the page in my divorce decree that states i get half of the profit. Is this okay to submit, and also the letter that another website says you must include?

Ohh... you don't actually have the money yet? In that case, it could be difficult, because houses don't sell well right now, so it could take a long time to sell or sell for much less than you expect. Considering you are clearly divorced already as you are re-married, how much longer until the sale of the house goes through? Are you reliant on listing that money as assets or is it only a bit extra to put on the I-864?

If you are going to use the funds from the house profit, you need to show the funds in your bank account which I am assuming you have to add as an asset. I used all assets but had to show where every single dollar was...checking, savings, two cars paid off, 401K etc. When using assets, I had the manager of my bank type each account I had open and funds in each account with her business card attached to the letter. Using 401k, the company sent me a typed letterhead as well with my funds up to date.

Now, I will say this much, using assets can be tricky so make sure you follow the guidelines as to what they need as proof. When my fiancé went for his interview, he was called to the window and was asked for his I864. The lady scrolled through the pages and said to him sorry you will need a co sponsor as she cannot show income. Mohammed tried to speak and explain to the lady that I was using assets but she didn't listen one bit and shook her head and said you need to call her and have her fax over the correct information, she let him go and get his cell phone from the holding area and call me. I told him she is wrong and assets can be used, he told her that but she said just go and sit down in a nasty tone and wait for your name to be called. At this point, Mohammed felt the interview had already been denied and was feeling a bit overwhelmed and sad.

Mohammed was the last to interview after hours of waiting and after hearing nothing but denials all day, he felt just exhausted once he got to the window. The interview went well, I was also called via telephone for an interview regarding our relationship, and at the end the consular said all is good except you will need to provide a co sponsor. I immediately questioned him as to why as it perfectly states on the I864 that assets can be used. The consular said to me, I have only what Is written on Mohammed's file in front of me (co sponsor needed). He then said to me, let me go and get the rest of his file and i864 and read through it. Five minutes later, he said Katrina you are absolutely correct and all is good. Visa approved....

I think you also mentioned using the camper as an asset. Make sure you have a copy of the title and is the camper title in your name and not someone else? I too had a camper paid off and added this as well, but you cannot just add the amount you paid for it, for example if you paid 8000 dollars for it, you just can't add 8000 in assets. I had to go and get an estimate as to what it was worth that day and not 5 years ago when I paid cash for it. The estimate will decrease way more than what you paid for it. I also had to have the estimate done on company letterhead where I had previously brought the camper as proof.

Hope this helps with using assets for you or anyone going this route.
