I have custody of my 4 granddaughters which brings my family size to 7 with my husband. They should be going back home with my son by the end of this year. I think according to the time line the NO2 should be in August some time. If we dont supply the Affidavit for a while will that close the process is the a time limit you have other than personal to submit all the documents to continue the process or will they make us start over again? Thanks

Are you seeking an IR-1 visa or adjusting status? I think you've posted in the wrong board.

Is it you or your husband that's immigrating? If you are immigrating, your husband doesn't need to include your granddaughters on his affidavit of support (because they will not be accompanying you to the U.S.). If is it your husband immigrating, and you are filing the affidavit of support, then yes you'd have to include them.

After you get NOA2, the NVC will send you correspondence to request (1) affidavit of support, and (2) an application for an immigrant visa. You have to submit either one of these documents within six months or a year to keep your case open, and then you get another six months or a year. So I think you will be okay, even if you have to file the application first and then wait a few more months to submit the affidavit of support.

Sorry IR-1 visa and I am the citizen. Thanks for the info. I think that my grandkids will be going home to their Dad soon so I thought if we had to wait a few months to file Affidavit of Support until they are gone then I would have to claim so many but I dont want to miss any deadlines either.

If you look around on the IR-1/CR-1 board or ask there, someone will be able to tell you what the deadline is for keeping your case open.
