Both my Father-in-law and Mother-in-law are filing as joint sponsors, however we encountered a section that confuses us.

They have their IRS transcripts, where they had filled as Married filed jointly where they do not separate the adjusted gross income.

how would they fill question 25 on I-864 and question 11 on I-864A

They could use their form 1040 tax returns to establish the amounts, or their individual W2's/1099's.

For current income simply calculate their present earnings for 52 weeks.

For a self employed person, it is a bit different.

I know I'm being repetitive but I need to understand it fully to be able to convince myself and both my in-laws that that is the right amount to print on q25. Stated on the Form and also the instructions was to enter the adjusted gross amount.

"My total income (adjusted gross income on IRS Form 1040EZ) as reported on my Federal tax returns for the most recent years was:"

On both the IRS transcript and the form 1040 tax return form, the adjusted gross amount would be a combination of both my in-laws salaries. It is not listed separately.

So is what you're telling me that they should enter as their Total income in q25 on I864 and on Q11 on I864a is their individual salaries? Or do you mean to enter the mount that is listed on their 1040 which is their combined income for both the I864 and I864a?

What confuses us is that. if we enter the amount stated on the Form 1040 it would be as though we're entering the same information twice.

One of them has to decide to be the sponsor, and the other has to decide to be the household member. It doesn't really matter who decides to be whom.

Whomever is going to be the household member, they enter their own total income on line 10 of the I-864A. Whomever is going to be the sponsor, they enter their own total income on line 23 and 24a of the I-864. They enter the household member's total income (from the I-864A) in section 24b of the I-864. They total up the two values on line 24c. The total should equal the total income line on the transcript or 1040.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Thanks JimVaPhuong. But what about question 25? that's the only part that we are confused on. questions 23 to 24 we're fine.
