Hello folks,

I applied I-485 while my dad sponsored me for the I-130 and AOS. I applied for the CSPA case because I came here in the US ahead of my family thru F-1 visa. I quit my job last May 30 to focus on my papers. Another reason I had to leave was I had to move from another city but same state because my family needs help getting used here in the US and for them to get situated especially my younger brother and sister going to high-school. My family just got here last April 2012. I don't plan to look for work until I get my green card if it gets approved. My OPT expires on Dec 2012.

My question, is it okay for me to do this? Out of job while still under STEM OPT status? Do I need to notify my international adviser regarding my situation? Any help and advice would be appreciated. Thanks!

May 24, 2012 - Sent I-485, I-130, AOS and related applications

June 6, 2012 - Fingerprints fee was accepted and online case status updated to Initial review. Same time I got the I-797C notice

June 20, 2012 - Got my Biometrics appointment scheduled for July 2

A condition of OPT is to not accumulate more than 90 days of "unemployment" during it - if you don't have a job for 3 months or longer, your OPT is essentially invalidated. With marriage based AOS application, filing the AOS paperwork gives the foreign applicant a new period of authorized stay, unrelated to the original non-immigrant visa status he/she entered with, that will last until there is a decision on the AOS application. I am not sure if it is the same for your type of an application, so hopefulyl someone here will know more about that.

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

Can you explain a little bit more about your situation? Is your dad an LPR or a U.S. citizen? When did he file your I-130 and is your priority date current, if you have one? I am just curious about why you qualify to adjust status under the CSPA.
