Help me with a question . my fiancee is coming on July 10th, we are going to get Married in July 27th and we have a cruise for our honeymoon to the Bahamas in July 30 th . the thing is that, is she available to leave the country before receiving the green card?

Thanks if somebody have some info .

No I think that she cannot go there if she doesn't have advance parole. She won't be able to come back to the usa.

You should postpone your reservations on the cruise as soon as possible. She can go, but she won't be able to re-enter the U.S. Once you're married and file the adjustment of status documents, you can also apply for advanced parole, but until then, she should not leave the U.S.

She can leave without any problem. Returning to the US will be impossible.

A honeymoon is not an emergency.

Marry, then file for the adjustment of status, advance parole, and employment authorization. If there is an emergency then you would supply proof of the emergency situation and make an infopass appointment at a local USCIS office to get the expedited advance parole.

You're dealing with USCIS. Strict rules apply with the K1 after entering the US. AP fee is waived/free when submitted with the AOS. It'll take around 3 months to get it in hand from filing until approved. It's valid until getting the greencard.

Getting an emergency AP would most likely require for you to bring proof to an info-pass appointment that it is indeed an emergency. You're just making it harder on people who really are in an emergency.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

You can apply for AP but it is a craps shoot as to if you will receive it. My recomendation would be to postpone the cruise. Many cruise lines will hold your payment and apply it to a future cruise with out penalty.

I have thought about a cruise honeymoon but with the USCIS requirements I have decided that Disney World is a great place to honeymoon!!

Sometimes, if you leave from an American port and you return to an American port a passport isn't even needed.

Will you be getting off of the boat in the Bahamas?

But be careful. She will have a major issue if something goes wrong and you guys have to fly home in an emergency.

The only time that would work is a cruise that never entered a foreign port, or possible never entered international waters. A travel agent isn't going to know the right answer and depending on the area they cover an immigration person could answer wrongly If the ship entered a forgien port all the passangers will have entered the country even if they stay on the boat. The countried line is out in the water not the shore

Absolutely not. If you leave, your spouse will NOT be able to enter the USA again until you refile for another visa.

Change your plans asap.

Don't ever do anything you're not willing to explain the paramedics.

Thanks everybody for the advice, so I just called to USCIS and the effectively said that first I need to apply for AOS and then if you want to work, travel or anything you need to ask for the respective permit, so I called and re scheduled the cruise to December but is really sad that you can go to the honeymoon when you have planned . I guess this is normal in such as complicated country like the USA.
