Really do not know what to do here.

My husband (for whatever reason, don't ask me, it doesn't make sense) refuses to change his driver's license from Florida to West Virginia, even though we've been here more than a month. I didn't know this until recently. Now we have interview coming up, and his DL address doesn't match the interview notice. I mean, it's not even the same state! I'm not sure whether he would be allowed into the USCIS office, and secondly, now I not only have to prove that we live together, I'll have to prove that HE lives here!!! And even if I manage to make him go change his license, there's really no time now (less than a week). Anyone had a problem like that? Any advice would be helpful.

751 is not adjustment of status it is removal of conditions.

All he has to say is he has not yet changed his drivers license since moving.

He will use his US passport to get into the USCIS office, not his DL. Just like you will use your expired GC and interview notice.

You must have other evidence of living together. Bills, bank statements, credit card statements, a joint lease or mortgage, mail, etc. There are many ways to show joint residency other than your DL's.

Like Inky said, just tell them you haven't changed it yet if it comes up. You've only been there for a month. What does the state law say? Some states give you a deadline to change your license over before you can be fined. I would look into that if you haven't.

My husband was exactly the same about moving from Iowa to Texas for school. He didn't want to get rid of his Iowa licence. His reasons were getting a Texas licence meant he was a resident of Texas which meant Texas insurance and Texas number plates on his car. As it turned out for his job he needed a Texas licence so he signed his car over to his dad who still lived in Iowa and kept his Iowa tags and insurance that way. When we moved back to Iowa he simply had his dad sign his car back over and changed his licence. No drama with insurance and tags.

As others said he can use his passport to get it but either way the address on his licence won't be an issue to get in. It'll only be a problem in that you don't share the same address on your licence which is easily explained with he hasn't got around to it yet. I assume yuo have other evidence like joint bills to the same addresss etc. the licences are just one piece of evidence and remember some people don't even have licences. it's not the end of the world.
