Just when I thought everything was going great. please help!

SOMEONE PLEASE HELP!

I obviously didn't meet the poverty guidelines for the past three years, I was in high school and only working part time. I did get two jobs for the year of 2011 but only worked 5 months because I left May 25, 2011 to Argentina with my spouse were we got married on July 25. THERE IS NO ONE WHO CAN BE MY SPONSOR. NOT EVEN MY PARENTS. and I am so scared because I don't want to get an RFE. I am assembling my I-864 packet now and I thought I was going to be okay. I got my job the same day my petition I-130 was approved and I made $440 weekly before taxes which sums up to $22,800 YEARLY. I have my paystubs for every week and and a letter from my employer and my school schedule as well since I'm a college student. Do I have to wait another 6 months so they won't ask for joint sponsor? I mean its personal but I didn't arrive back to Texas until Mar 21 but to take care of my dad because he was hospitalized. But will they take in consideration the fact that high school students don't make that amount of money when in school? Right now I have only been working for 5 weeks All help is greatly appreciated.

Well to answer your question honestly, yes they do take into consideration that a high school student doesn't make that amount of money. They take it into consideration for everyone. It is just a requirement, not a bias towards high schoolers. Are you saying that because you are a high schooler you should get preferential treatment? Let's face this honestly, being married is a huge financial obligation. HUGE. In order to bring someone into this country, YOU have to prove to our government that beneficiary will not become a burden. Bad things happen to good people. I applaud you for taking care of your dad while he was in the hospital. I applaud you for working 2 jobs. All you can do is give them your current paystubs and the letter from your employer and see what they say. They do not care about your school schedule. This is not being mean, rather just a fact of the way it is. I wish you the best and I hope this turns out favorable for you. But you have to realize that the system is in place for a reason and there is no getting away from it.

Well to answer your question honestly, yes they do take into consideration that a high school student doesn't make that amount of money. They take it into consideration for everyone. It is just a requirement, not a bias towards high schoolers. Are you saying that because you are a high schooler you should get preferential treatment? Let's face this honestly, being married is a huge financial obligation. HUGE. I am not saying that because I was in high school , that I should receive some kind of special treatment. I just wanted to know if they would take that into consideration. When we filed our I-864 my husband had been at his (well paying) job for only a few months. Prior to that we were in Scotland for 3 years, where he was a grad student, and he barely made any money.

You have to file the previous 3 years tax returns (even if, like my husband, all it shows is your lack of income for the previous years) but what is important is that you earn enough now. The previous poster is right in that being in college doesn't negate the financial requirement. But if you are filing for 2, you meet that requirement with $22,000. So no worries.

When we filed our I-864 my husband had been at his (well paying) job for only a few months. Prior to that we were in Scotland for 3 years, where he was a grad student, and he barely made any money.

You have to file the previous 3 years tax returns (even if, like my husband, all it shows is your lack of income for the previous years) but what is important is that you earn enough now. The previous poster is right in that being in college doesn't negate the financial requirement. But if you are filing for 2, you meet that requirement with $22,000. So no worries.

I understand the frustration. But your question about USCIS taking into consideration about your being in high school did imply they should give you different consideration. The consideration being because you were in high school. The major issue here is will they accept you working for a couple of months as enough to meet the requirements for affidavit of support. I have seen where they have approved short term employment and I have seen a couple of people given a RFE. I hope that you do not have any problems. That is my wish for everyone going through this hard process. I have learned through this process that there is no such thing as leniency when it comes to the government. Right now the wait for our AOS appears to be over 6 months. With Obama's new initiative about illegal aliens being allowed to work (certain requirements do apply) that their applications will take precedence over ours. (Not to mention the Tsunami victims applying for immigration here because of the terrible act of nature they endured.) Here we are, US citizens following the letter of the law and paying terribly high fees for these applications, being kicked to the bottom of the pile. So, my motto is "Hope for the best, prepare for the worst!"

The consideration being because you were in high school. The major issue here is will they accept you working for a couple of months as enough to meet the requirements for affidavit of support. I'm sorry but you got me confused now. because my petition has been approved already and my case is at the NVC stage at this point and I have paid my AOS bill so I don't think I'm going to have a 6 month wait because my petiton is approved..the rambling doesn't bother me. it's actually helpful and thanks

I think you are referring to Adjustment of Status. I am doing mines for a visa for my spouse.

I did not read anything in your post that indicated that you were looking for preferential treatment because of high school or taking care of your Father.
