Hi Visa journey members I am new here and so glad I found this site to share everyone's confusing minds of visa process. I am in my AOS process now and I got RFE for the joint sponsor's documents. USCIS sent me a mail that I need to submit a complete tax return. I got it with me and ready would be ready to mail BUT....I have a question. She gave me her W2 and 1040. NOTE: the couple filed tax jointly our joint sponsor who signed the supporting affidavit is a wife and she is working/ while the husband is retired. I am so confused which number from the form 1040 showed as her income? is it also shows on her W2? Please any help will be appreciated.

The RFE is asking for the COMPLETE return. You need more than just the 1040 and W-2. Most people have more to their returns than just the 1040. She needs to provide the 1040 and all schedules, attachment pages, W-2s and or 1099s. You need to provide the USCIS with a complete copy of everything that was mailed to the IRS, or would have been mailed, if e-filed.

The joint taxes show the combination of their incomes. Her individual income is shown on her W-2. Her individual income must be enough to meet the 125% requirement for her household size plus the intending immigrant. So, if it is just herself and her spouse with no kids or other dependents, then she needs to make enough for a household of 3, or more if she other dependents not mentioned here. http://www.uscis.gov/files/form/i-864p.pdf

Follow up question please, She gave me only her 1040 and her W2. Her income on her W2 is not the same from the income shown in her 1040 because her husband and her filed jointly so if I am not wrong her income herself is on W2 not on the 1040, correct? So if we submit her W2 and her 1040 is will be enough? Is her 1040 a complete tax return? She gave me 2pages of 1040 showing the couples income which is line #1 to line #77 I wonder if this is the correct or complete form she gave me I just want to make sure I will mail the right stuff once, I don't want to get another RFE.

Yes, her income alone is on her W-2. As I stated before, she needs to give you her complete tax return. Most people have more than just the 1040 and W-2. You will have to ask her if that is the entire, complete tax return that she mailed or e-filed. She needs to give you everything she mailed or had e-filed. Any and all forms, schedules, attachment sheets, etc. Whatever was included in the filing of her taxes is what the USCIS is asking to see.

The best way to do this is to have your partner order a 'tax transcript' from the IRS. They are free of charge, and are available any time. He can now order one for 2011. It will take 1 to 2 weeks to arrive.

Just want to state that if you have your joint sponsor order a 2011 tax transcript from the IRS instead, be sure to still include her W-2 to show her individual income since it is a joint filing.

I would personally still try and get the complete return with all the forms, schedules, and attached pages plus the W-2 and/or 1099s from her since that is what the RFE specifically asked for.
