ok, here is the story, I NEED INFO PLEASE,

My 2 sons now age 11 and 18 and myself came to USA on CR1 and CR2 visa which 2 years expires Aug 22,2012, we have submitted the joint I751 already for all of us, Now my 18 year old son has decided he wants to be educated in Canada and wants to go now and start working as well as activate his own Manitoba Health Card. and SIN, and Drivers license and WELL EVERYTHING, my question and concern is this

Will my son lose his green card status? He will be coming back to USA for visits about every 4-6 months, but is going to University for awhile (MED SCHOOL) in Canada, and needs to work to help pay for school.

DOes he need special papers to go back to Canada?

should have inform USA immigration, as I sent in I751 for him 3 weeks ago? he will come back for biometrics appt.

what happens if he wants to come back and live with us in USA?

will he have to start whole process over?

will he lose his perm. res. status?

should I file any papers for him?

If anyone has any info please help this is driving me crazy ONCE again

Thank you y'all

SMURFIN AWESOME!!!!

My biggest concern is the Manitoba Health Care, which makes sense since he'll be in Manitoba for a while. Now if he does this, he is declaring that he is a residence of Manitoba, obviously he will be to obtain this provincial benefit. Doing this will put his US residency in danger as he cannot be a resident of the US AND of Manitoba

make sense?

Have you looked into a re-entry permit? Not sure if this will work if he declares residency in Canada

Good luck

I wonder if there is a way he can claim temporary residence while he is going to school while maintaining a permanent residence in the US?

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

Our immigration attorney was clear to us that if my 16 year old son wanted to return to Canada for University instead of staying in the USA for school while just a Permanent Resident, it would have to be very clear that it was only for school, with him never working in Canada and not filing taxes in Canada as a resident, only there as a student and back home here to the USA in the summers. After the two year conditional Green Card period, there was more flexibility, but he would need five years here in USA for applying for Citizenship and they wouldn't be counting the periods he was away at school.
