going to university in Canada

Timeline

ok, here is the story, I NEED INFO PLEASE,

My 2 sons now age 11 and 18 and myself came to USA on CR1 and CR2 visa which 2 years expires Aug 22,2012, we have submitted the joint I751 already for all of us, Now my 18 year old son has decided he wants to be educated in Canada and wants to go now and start working as well as activate his own Manitoba Health Card. and SIN, and Drivers license and WELL EVERYTHING, my question and concern is this

Will my son lose his green card status? He will be coming back to USA for visits about every 4-6 months, but is going to University for awhile (MED SCHOOL) in Canada, and needs to work to help pay for school.

DOes he need special papers to go back to Canada?

should have inform USA immigration, as I sent in I751 for him 3 weeks ago? he will come back for biometrics appt.

what happens if he wants to come back and live with us in USA?

will he have to start whole process over?

will he lose his perm. res. status?

should I file any papers for him?

If anyone has any info please help this is driving me crazy ONCE again

He could lose it, all depends. Generally students are fine, if they are just doing school. Coming back every 4-6 months is meaningless. It will be up to the USCIS every time he crosses to decide. They should be ok if they can show proof that they are still technically living with you in the US. Another option would be to file for a re-entry permit which you may have to do. This will preserve their residency at a cost of possibly resetting their residency clock.

Generally they should be fine, many people do this, but just know every border guard can inquire and deny entry to anyone but a USC, so there is always a possibility of them being harsh, but it is rare to revoke a GC under a study abroad type thing unless there is 100% proof that the person studying abroad is living and residing and being in school and just coming to the US to 'visit' for a few days or weeks every so often...

Aug - Filed for AOS

Sep - Recieved EAD

Sep - Recieved Advanced Parole

2004

Jan - Interview, accepted for Green Card

Feb - Green Card Arrived in mail

2005

Oct - I-751 sent off

2006

Jan - 10 year Green Card accepted

Mar - 10 year Green Card arrived

Oct - Filed N-400 for Naturalization

Nov - Biometrics done

Nov - Just recieved Naturalization Interview date for Jan.

2007

Jan - Naturalization Interview Completed

Feb - Oath Letter recieved

Feb - Oath Ceremony

Feb 21 - Finally a US CITIZEN (yay)

Timeline

Normally when ppl return to go to school they go as non residents. They pay the higher tuition. Aalso not reactivating his Manitoba health care, since he is only there for school not a returning resident. He would be able to work but he would also have to make sure he is not counted as a resident tax wise.

It is possible but you must take the proper steps if you are wanting to keep his GC.
