What status between AOS & Green Card?

I've arrived in US with K-1 visa, married my love and now I've sent in the AOS package. My question is: What sort of status do I have between now and when I get the green card? My K-1 visa runs out in a week, so what sort of legal standing do I have to remain in the country? If I was to encounter ICE or police or something they'd see my visa has run it's course, what and how would I be able to show to explain that i'm in the progress of AOS and still fully legally present in this country?

Thank you in advance!

You have to show the NOA1 from the AOS filing.

Your status is considered pending when you have filed AOS.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Your visa expired upon entry. Your I-94 expires 90 days after entry.

Your status post I-94 expiry is adjustment of status applied for / pending. The NOA1 acknowledging the AOS application would "confirm" this status.

When an alien has an adjustment of status application pending then the law refers to them as being in a "period of authorized stay". In other words, your immigration status does not change, but you are not accumulating unlawful presence, and you are protected from removal. The receipt notice for the I-485 serves as proof of your authorized stay.

In answer to my question about this same thing, a very sharp immigration attorney told me that people at this stage are referred to as "applicants for adjustment" or (more simply) as "adjustment applicants."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thank you everyone, I appreciate your respose.

Addition quick question. Will I be able to extend my driver's license with the AOS since it runs out the day my 3 month visa is suppose to run out as well? Will DMV accept NOA to prong it?

Thank you again!

That depends on what state your in and what their rules are.

You have to ask the DMV. All of them are different.

I can only speak for California but no they won't. I have just been on the phone to them, they wouldn't even grant me a license on my I94. You have to wait until your green card comes through, NOA is not proof of legal status.

So pissed off about this right now! Sometimes I think the US is even more bureaucratic that the UK!!

Everything has changed since 9/11. I can't blame US for all the changes and stricter rules because of what those people

did.

Before, in California even if your on a b1/b2 visa, you can still get drivers license

but now you have to have a social security # or your green card

FYI in Ohio your notice from immigration is all you need to renew your license. The work authorization card that also serves as advance parole showed up quickly allowing my son to obtain his ss card. I think they used the form number I 797.
