Hello VJers,

We are applyng for a K-1 Visa

It is looking like my Fiancee Rose will have her interview at USEM around the same time as the birth of our son (he wil be born in PH).

Is it mandatory to file a CRBA AND wait for his passport to be issued before we travel back to the States?

I read somewhere that it is not mandatory for him to have a passport, but there may be an "exit fee". Is anyone familiar with that?

Thank you guys,

Kelly

I don't know if it will be possible for the child to leave the Philippines without a passport, but he will not be admitted to the United States without a passport. It's also highly likely that the airline will refuse to board him without a passport.

The US Embassy in Manila will not issue a visa to a child that has a claim to US citizenship. You'll need to complete the CRBA.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

In addition to filing the CRBA, your US citizen child will also need a US passport. A Philippines passport will not be accepted since your child is a US citizen seeking to enter the US. A US citizen must have a valid US passport when entering the US.

FYI, one does not come with out the other.

Note: OP, If your child is in the PI with only CRBA/US passport, you need to make sure you get your child his/her PI passport if you do not your looking at costly fees from the BI (Philippine Bureau of Immigration) exit permit and or late fees, when the child exits the Philippines. One plus is with both US and PI passport your child will have Dual Citizenship, with out hassle of paper work/fees down the road.

Jim,

Do you know how long it takes to get the birth certificate after the baby is born? ANSWERS IN BOLD :

In the Phils, a certificate of live birth will be issued to your wife 1-2weeks after she gives birth. She has to claim it at the hospital where she gave birth. Your wife then has to wait again for 4-6weeks (estimate) for it to be entered into the NSO system. After that, she can get the birth cert from NSO. It is a requirement that all birth certs must be issued only by NSO security paper for it to be accepted by DFA, where she get a passport for the child.

How long it takes to get US passport after filing CRBA? No idea about this-sorry

How long it takes to get PH passport? Expedite processing: 1-2 weeks Normal processing: 1-2 months

If you indeed decide to get a PH passport for your child, Dont worry, it will be easy for your wife/fiancee..BECAUSE MINOR CHILDREN ARE CONSIDERED A PRIORITY!! They will be accommodated ASAP!

Hope this helps..

Thanks,

Kelly

I just went through this same process this week. I got the NSO copy of my daughters BC after about 15 days, and I live in the Visayas.. I got my copy of the BC the day after my daughter was born and the hospital took a copy to the LCR, there was some mistakes so i had to delay the processing to fix it. See if you can get an "advanced endorsement" from the LCR. They will forward the BC directly to the NSO and you can get it after 10 working days(for me it was 10 working days and I have done this twice). I have heard that this only applies to the provinces but im not certain. I dont know where you live though. There is info about it here: https://www.ecensus.com.ph/Secure/FAQs.aspx its under question #16. Also when your fiancee has her interview they will ask if you have applied for the CRBA and stuff. My wife just had her interview yesterday and both interviewers asked. We just did our CRBA and passport for our baby on tuesday and the CO said that it will take about 3-4 weeks. The guy at the Air21 counter said to expect 4 weeks because of where I live on Samar. I also just went to get the philippine passport and on the website for DFA Manila it says 14 days for normal processing and 7 days for expedited; but in Tacloban where i filed it was 35 days for normal and 20 days for expedited. So apparently it depends on what DFA you go to. Hope this helps!
