In Section 18 of I-129F: Has your fiance(e) met and seen you within the two-year period immediately preceding the filing of this petition? Yes or No. Describe the circumstances under which you met. If you have not personally met each other, explain how the relationship was established.

I'm not sure if this applies to your case. Good luck!

It is extremely rare that it would apply to anyone's case and it most certainly did not apply to the OP's situation. The OP was denied just like everyone said would happen. They are very strict about the requirement to meet in person within the 2 years prior to filing.

I dont know why he didnt do as he was told. Sounds like your fiancee should educate himself on these processes so you guys dont have any issues going forward. Tell him to get on this site, do some research, etc.

someone told me to ask my fiance to call uscis and direct to tier2 (person inside the uscis not the csr)

and tell everything or ask and inquire what should we do if continue or to withdraw.

another question is: if we let this denied and plan to re-file again, the re-file petition will not meet problems bcoz of past k1 filing denied?

and I also read some attorney offer help for waivers does this will help?

just wanna know..

I would stay away from obtaining an Attorney for this issue. It will most likely cost you a lot of money with no positive results to show for it. Been there done that.

I would do the CR-1 because it is cheaper and you can work right away when you get to the USA.

well we're talking about cr1 earlier before I log in here.

but we have a child and in our child's birth certificate says we are not married (coz' we are)

and we are wondering if we do cr1 then update the bcert of our child it a lot of work

and 2wks prepa in wedding is not good..

but I like the idea that I can work asap once I get to USA..(but not necessary to work immediately, hehe)

I am okay now, I am good and still learning things.. I told him to move on

coz' am so worried to him he's so devastated and down

♥♥God gave you to me. I asked Him why, He said, “Because he can fill your life like no one else can.” ♥♥I love you and I really miss you so much luv!♥♥Hope to be with you soon and have a happy family!♥♥

No need to update the birth cert- after all you were not married when the child was born, so the cert is correct.

But, yes, getting a wedding organised in 2 weeks may be difficult!

Bye: Penguin

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I clearly wanna know

we are denied ( waiting for hard copy of denied noa2) okay.. so then, if he flew here in Philippines on 2nd week of September and flew back to USA on or before October, but we did not get married , because we decided to file again k1/k2..

our denied k1/k2 will not affect our new k1 filing? (coz' we plan to file again before end of October, its only 2mos from the first denied k1/k2)

No it won't negatively affect you. The problem is you didn't meet in the last 2 years so meeting fulfils that requirement and you're good to file again.

If you were only denied because of not meeting the meeting requirement then yes, you can file another K1 as soon as you want.

yes I Think so..

by the way I wanna ask about cr1

as u said we don't have to update the bcert of our child since we are not yet married when the child was born

if ever we file cr1/cr2

the cert of child will conflict coz it says not married

but we are now married

Wait a minute... you've said this twice now. You ARE married? If this is the case the K1 no longer applies to you, and you will have to file for a CR1

my question is: what if the uscis or consulate asks about why we file cr1/cr2 (spouse visa) if they saw our child's bcert and indicated that we are not married because we did not update it

coz' Penguin_ie said we don't need to update our child's bcert even if we get married here for cr1/cr2 filing

Yes, what Penguin said is correct. No need to update the BC because the truth is you weren't married when your child was born.

If you get married in the Philippines, he should be able to file a CR1 petition without any issues as far as that's concerned.

I see.

so we will have to choose between k1/k2 (fiancee) or cr1/cr2 (spouse)

as of now we are in hurry we want to be together as soon as possible and we want our child to possible go to school this year.

so for the time - better to get k1/k2?

by the way one more question, as I read back I read expedite request

are we eligible for expedite request?

does requesting for expedition affect our k1/k2?

can we use the old k1 application a reason since we get denied by just the 2yrs req?

Have you two been face to face again since the previous denial, yet? If not, that's the first thing you STILL have to do.

If I were you, once he goes there to see you, I would marry there and file the CR1 and forget about K1.
