I am sorry to hear of your situation. Like everyone is saying,I do not believe there is anyway you can get around meeting in person within the last 2 years before filing. I understand that you are sad. Please make sure that attorney is not a crook . Ask for references before hiring this attorney. Like others have said,your best bet at this is to have your spouse to come back to the Philippines and

1.keep his ticket and boarding pass to show as proof

2.take lots of pictures with you and your relatives

3.write a good Letter of intent to marry you within 90 days of arriving here in the USA. --signed by you and him and possibly a witness

4.Uscis is very strict with that 90days. I know a person that got married on the 91st day. Technically,she was out of status on the 91st day and that created some problems.

someone told me to ask my fiance to call uscis and direct to tier2 (person inside the uscis not the csr)

and tell everything or ask and inquire what should we do if continue or to withdraw.

another question is: if we let this denied and plan to re-file again, the re-file petition will not meet problems bcoz of past k1 filing denied?

and I also read some attorney offer help for waivers does this will help?

By refiling, you can make sure the evidence is airtight.

You'll have exactly the right kinds of pictures (ones with other people in them always--one with family, one with friends, one in a public place that is immediately identifiable, 6-10 are a good selection)

You'll have receipts for everything--ATM usage, hotel together (if you go), entrance tickets to the theatre/zoo/a train ride/tour/etc.

You will have all your boarding passes (and not lose them or think they aren't important).

You can hopefully avoid the tears and frustration and costs of an RFE.

You can get handwritten affidavits from friends and family IN PERSON and not have to wait.

You can front-load your petition after reading everything on here about the embassy where the interview will take place so that your petition is "custom-designed".

The waiver is not worth the time but a waste of time. It is not a gamble, it will be denied.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

The waiver will be denied. You are wasting your time waiting for something that will not happen. The rules are very strict, and are clearly written in the instructions.

Search the forums and you will find soneone who mailed off the I-129F packet and the USCIS received it 2 days after they met two years ago and it was rejected. The instructions are very very very specific that you must have met in person within the last two year. Not two years plus a day or a month but WITHIN the last two year or 730 days. No exceptions that I know of. If you have the time and money go ahead, but you will be more ahead by meeting again and re-filing like the OP.

Anyone here? Encountered this kind of situation?

Hi we got RFE last June 20 and got the hardcopy today. It says we have to submit photos from certain year January 2010 to January 2012. But the problem is WE DON'T HAVE! My fiance went here in the Philippines for 3weeks vacation last OCT.2009 and then he flew back to US. We just chat, talk, sending emails since then.

Please advice us in a most possible and positive way to avoid denial of the petition. We are so worried to death and stress strike back again after my concern in k2.

Please help us to solve this please!? :crying:

Sending all the photos isn't going to help them now when the RFE is specifically seeking photos within the two-year timeframe before filing the petition. As has been mentioned time and time again, the meeting within two years is a strict requirement of the I-129F. The petitioner needs to ensure they read the I-129F instructions carefully and abide by them. Had they read the instructions thoroughly rather than trying their luck, they wouldn't be in this predicament right now where they're facing an even longer wait and more money spent (trip + filing a new petition).

Uhmm, no. The RFE is asking them to produce evidence that they met in person during the 2 years prior to them filing their I-129F. They cannot go take pictures now and claim they were from before. In case it is not said often enough, lying for immigration purposes is bad.

Her fiance does need to go back and visit her, but they need to withdraw the current petition and file again after they have a face-to-face visit that meets the requirement of the I-129F.

to update he did not obey me to withdraw and it's been two months we try our luck

but yes, we are denied!!!

now am telling him but not blaming him that I said so to withdraw.. I told him he needs to get back here in Philippines

either we get married or file another k1 again..

I told him to go here as soon as possible on 2nd week of sept so that he could file again for K1 petition on oct 1st week.

he asked me what is the better thing to do,

now guys my follow-up questions:

do we have to get married here in Philippines? then file for cr1 visa (we have a child, anyway)

or

do we have to file another k1?

if we married here - file cr1/cr2 - how many months to get approved? does it like k1 with only 6mos timeline?

if we decide to file another k1 again - what should we do? do we have to inform uscis that we are filing again because we are denied? do we have to wait for hard copy of denial before he go here in Philippines?

does K1 denied petition need to wait to file again (even he already flew here in Phil just to see me?

I hope all my questions will answer

you could do either one :thumbs:

but to be honest i will do the K1 because the processing seems faster compare to cr1 lol

this time make sure take A LOT of photo..and don't forget to put the setting for time and date stamp for the photo.

follow the simple guidelines here in VJ...make sure you guys sign every documents..and here's another link how to properly file your K1

I would do the CR-1 because it is cheaper and you can work right away when you get to the USA.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
