Wow... I'm awake now.

Yes..I am the beneficiary/or the applicant

My daughter is the petitioner.

I have no GC. I stayed out too long (due to my fathers death)

I personally couldn't bring it over my heart to leave him to die alone.

I filed a I-407, to start the whole process.

When I say my life is in the USA, than I mean it.

I know no one here, and have nothing here.

oh ok i thought you said you have a green card, because if you did i would want to know why you had to go through the process again...but i get it now im sorry about your dad....you did the right thing and you should be proud.

Don't worry.....RFE mean good thing and you're not in the bottom of the pile, instead of instant approval by now you're delay for few more week. It probably something you forgot to submit on the checklist ???. I usually make 2 copied of everything I submitted to USCIS and triple check everything.

FYI -

By submitting more papers than what required on checklist will just delay the process per USCIS instruction of each application. @CS, Obvious, this is not your case.

I agree with the 2 copies of everything. I have the folder with original, and one with copies.

I write a cover page. Listing everything submitted by page. (This is the first to see)

I submitted only the requested. But would more, if I were unsure.

Thank You. You now really got my waterworks going. There is no time frame to when someone dies.

It was a tough decision, one I feel proud of, but scared at the same time.

Now I pray my decision will be rewarded and I get to go back home.

Awww dont worry you'll get to come back, we dont always get what we want but we always get what we need so just keep having faith, as you need to be home...

If thats the case, then that may well be what our RFE is about. If its something that simple then so much the better!

You said that you got an RFE, and your still waiting past the other peoples processing time? Thats not a good sign for us....

Nope I never got any RFE but usually it missing papers from checklist or they just need additional supported info from what you have submitted.

I'm just curious but don't quote me on it. For those country not on a high risk list can travel in / out of US anytime, for that matter would IR-5 category be similar to K1 procedures?. A petitioner would still submit i130 and once USCIS have accepted in there system on waiting list, beneficiary can over stay past 90 days mark while awaiting for approval.

Passport Timeline (Submitted at USPS, Standard Processing, Standard Delivery, Locator number: 51) & SSA Update & Naturalization Certificate Receipt

 

03/23/2022: Application for passport submitted at USPS facility under standard processing.

04/04/2022: Status changed to “The U.S. Department of State has received your application for your passport book on 04/04/2022. We're now reviewing your application and supporting documents...Your application locator number is 51*******.

04/04/2022: Check for passport cashed.

05/03/2022: Status changed to "The U.S. Department of State approved your application for your passport book. We're now printing your passport book and preparing to give it to you. You should receive your passport book on or around 05/09/2022."

05/05/2022: Passport Received.

05/09/2022: SSA Citizenship Status Updated.

05/25/2022: Naturalization Certificate received in mail.

Wow. Now don't quote me on this one. But when you speak of overstaying...this means the beneficiary is inside the USA.

I wouldn't risk staying if the I-130 hasn't been filed at least. But being inside the USA, you should file all at one time within the U.S. to be on the safe side. But if you filed the I-130 outside-than inform them that you want it transferred because the beneficiary is inside the U.S. Just don't let time run out.

I personally can't travel to the U.S. until I'm through the procedure. There is the chance I don't get through the POE with my paper work pending. So I was told. I'm computerized now with intend for GC.

Fiancee Visa...you file for fiancee Visa to enter...get married within 90 days (better before)...file immediately for adjustment of status....after this fiancee gets to stay until application is processed...A Fiancee Visa is an non-immigrant Visa-usually leading to immigration benefits. Adjustment of status papers are pretty much the same. Just different in letter and numbers to define where they have been filed, under what category.
