I Am moroccan married to an american citizen from philadelphia PA since march 2009,we got married in morocco,she came back to usa and there she delivered our son in the end of 2009.she filed for me but later she changed her mind and hired a lawyer for a divorce.I Don't want to go to the human side in the story,I just want help about the law side and rights.I can't go to see my son there because of the stupid visa law and she doesn't want to bring him here so I can see him.I want help what or how should I do with this woman to save my rights as a father.thank you so much for help

i know there some bi...... that destroy the marriage name and i have my wife from the same place and the sam country and im moroccan too

i dont believe what you said and im sure it happened :(

may allah help you and give you patient , and for sure there is somthing you can do but its gonna be a long way that will need alot of patient

i swear i ask allah to help you and make a big gate for you so you can seee your son

I am not accusing the OP of anything. I am only commenting on One-Heart's conclusion that the OP's former wife is a "bi...... that destroy the marriage name" without knowing the details of the OP's marriage.

One-heart, you, don't know what happen, and neither do I. There may have been a very good reason why she filed for divorce. Calling the OP's former wife a "bi....." without knowing the details is naive.

Everyone though my former son-in-law was a good guy. Then he hit my step-daughter. He put her in the hospital. She divorced him. Divorcing her abusive husband doesn't make her a "bi....."

Once again, I am not accusing the OP of anything. I don't know what happened in his marriage. All I am saying is that it is unfair to call his former wife a "bi..... that destroy the marriage name" without knowing what happened and only after hearing one side.

Contact your government and ask for help.

If you want to exercise your rights as a father, then you need to file a lawsuit in family court in the state where your son lives. Without your ex-wife's cooperation, a lawsuit is your only option.

A court cannot issue you a visa to come and visit. A court can order the mother to allow you to visit with your child here in the US. That may be a supervised (with a court officer) visit or not.

As posted above, you will need the help of a US family law attorney. I suggest that you find an attorney with experience with cases involving parents who live outside the US.

After that you would have to secure a visa to visit.

very sad and I hope that you can see your son someday. I don't think it is right that you have not seen him and I understand the distance is the issue also. It could also be she knows that the law that if she were to bring your son too see you, you could refuse her to leave with him, since the father has the rights in Morocco. I did read up on that and this could scare her also. As another person said, I dont know your situation,I am just trying to think of reasons why she won't bring your son too see you.

It is always unfortunate when a child is kept from a parent. You said that she had the child in the US do you know if you were added to the birth certificate? Has paternity been proven? I am not passing judgement on anyone but those are key facts if you decide to fight for your parental rights. As stated earlier the State Department warns American women that a father can keep the child from leaving Morocco and vice versa it will be a tough task trying to force her to bring the child to you.

JimVaPhuong is correct a U.S. Court won't allow you to bring the child to Marocco. An American child with a Moroccan father is considered Moroccan, the child can't leave Marocco without your approval. Noncustodial parent is entitled to visitation right, a U.S. Court may allow you to visit your child in the USA, but you have to solve the problem regarding the tourist visa.
