Seems like you missed the guides and what proof is, just not a piece of paper. Look at other threads and what others have offered to them for examples.

Getting married doesn't prove that a relationship is real. That's why you have to show proof of a Bonafide relationship.

And yes everything we present in this process when it comes down to our case at embassy and that CO getting assigned your case is totally left to their discretion. That's why its vital to provide everything you can to paint that picture of a real relationship.

Ok, I'm learning. Apparenlty he got his NOOA2 ok. My fiance and I have such a close and loving relationship it would be hard to take if the embassy determined that it was not Bona Fide.

The NOA2 is way back at the beginning at the USCIS. All they check is that u presented the required documents and filled everything out correctly. An approval there doesn't mean a VISA. The denial spoken here is at the interview.

Don't worry dear if you presented good quality of evidence u should be fine.

Also depends on embassy. Philippines is no joke since u say u r new I would suggest go to your countries embassy reviews and see the kind of questions and demeanor of CO's it will help prepare u and sooth your mind.

Not much you can do about what's already presented. But just preparimg in advance gives you the best means to success. Good luck.

Your options are :

To wait until you get a NOIR/NOID from USCIS stating the reason for denial, which takes a very long time but they usually

just let the petition expire and you may not even receive the reason/letter. Then you can file again but without knowing the reason you may run into the same problem again.

You can immediately, as in now, contact your senator to ask for precise details of evidence on your behalf....long shot but others have been successful and were able to have another interview and get approved. The senator's aid needs to do that in the next 1-2 days before the petition physically gets returned.

If a factual reason is discovered then privacy issues(of beneficiary)may prevent them from telling you.

They must have factual evidence and you must know the factual evidence to overcome the hurdle.

If they make a discretional decision based on speculation or just a hunch without factual evidence then you have a chance to either get another interview or have the USCIS reaffirm it at which time it will go back to the embassy.

You can't overcome what you don't know. Lagos for example denies many K1's and when the couples marry and try again they get approved...not always but often. It is a gamble. African applicants are scrutinized more than others and often get denied out of hunches and mere speculation. Having said that, fraud and scammers exists and evidence of it are reasons for denial.

Without any idea on how the 2 home investigations went it is impossible to guess what was said, discovered or speculated.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Here is a thread with a happy ending when a K1 was denied in Lagos and through the petitioner's representative the reason was discovered, the beneficiary was called to another interview and approved.

How efficient your senator / representative will be depends on how well you can communicate everything to him and how willing he is to fight for you.

Call and email the embassy even though they say not to. Be persistent. Get sworn affidavits together from people who

know your relationship is real and any other evidence you may not have thought about, dig deep, do it quickly for the senator to submit it.

You need to contact the National Visa Center (NVC), call don't write, and find out EXACTLY why she was denied a visa. THIS IS YOUR RIGHT and they must tell you. You can try to contact your senator or congressman but they weren't able to help me.

The last time I heard a spousal/fiancee visa was denied was because of the interview with the woman's friends, they lied to make her look good. They thought they were helping but of course they weren't. I would go back to everyone that was interviewed and ask them the questions they were asked and what their reply was.

i the only proof that i did have was chat record. otherwise i sent photo email, phone record, flight tickets and entry visa on my passport. the thing is that i was only known by her mom and one cousin in her family, and there were no proof of the two families together in a fiancee ceremony; like the dowry.

Is it common in this country to have an engagement ceremony? If it is common and you don't have evidence, then maybe that was the reason.

they are right you need to find out why she was denied and you need to act now! back in 2008 my fiancee was denied for the same reason. but even with my lawyer and returning to the Embassy to try to find out why all i was told was that the dission was final on their part and the case was going back to the USCIS. ( when in fact it goes to the NVC first and they are your best bet once the case does return state side)

in my case even being there for the interview, had a lawyer, plenty of profe, i was floored! and to this day i still do not know why or what happened. even after filing FOIA with the USCIS, nothing.

Act now! try to get a second interview and if not call the NVC and file an appeal with the USCIS.

Please don't giveup.. I don't know exactly what to tell you.. I have heard of some petioners contacting their Congress and Senate Reps. 8 months and 3 trips is a big investment pls get the facts and develop a plan of action. I feel for you but don't give up!!

Hello,did y send pictures or photos with yr file? Could you confirm age difference between y and yr partner? How long have you been together. If y do not have any photos togethers ,did y write statements ab what did u do there when y went to see her.?

Also, i will advise you to sort out yr k1 visa before trying for a quick fix as u will have this refusal on yr file. I believe y can appeal.

i understand that she was a little nervous during the interview. and one question that was troublesome to was that they asked her what are the basis of our relationship? she could not understand the question to answer correctly.

If she could not understand, she should have asked the CO to explain what they really meant by that. She should not answer without certain understanding. Lack of proof to show the CO and her uncertain answer to the question along with how she was nervous, these must have led the CO to not believe that this is a genuine relationship (relationship for immigration purpose only). Please don't get me wrong I'm not saying your relationship is for immigration, but this is on the CO's mind based on the letter you attached on an early post.

yes i agreed because on the second home visit by the consulate officer. she was old that she was to go to the us just to make her life situation better. at first she was being told that she is my cousin.

OP, what's the status update of your case? Did you contact your Senator? Or request a 2nd interview? Plese let us know how this worked out! I pray you were able to get some more clear answers or schedule another interview before they sent your case back to USCIS.
