Tax Return Extension

Hi,

I sent in my AOS packet on May 21st and the packet was received on May 25th. I then received a RFE requesting evidence for the I-864. I am going to send them a Letter Of Employment as evidence and pay stubs so I think we are fine on that part. As for the other request, they are asking for the most recent year of tax returns. I sent them 2008, 2009, and 2010 because my husband has not filed taxes for 2011 yet. He asked for an extension and they granted him one. So my question is this - Can I send them a letter explaining the situation of having an extension? If not a letter then what exactly do I need to send them? Or are they going to make us wait until the taxes are filed? Lastly, will that be sufficient in proving that my husband makes more than enough money to cover the poverty guideline? Thank you.

If your husband is self employed, then the 2011tax return is required. If he is an employee with a job and regular paycheck then the extension letter ought to be sufficient.

If your husband is self employed, then the 2011tax return is required. If he is an employee with a job and regular paycheck then the extension letter ought to be sufficient.

Just wanted to add: Do not just send an explanation about filing for an extension alone. You need to send them a copy of the extension letter receipt from the IRS.
