Hello all~ This is my first post started on VJ. So I guess a quick background...

Moved to Tokyo. Worked as English teacher. New staff started job. Amazing woman. Fell in love. Got better job in America. Moved back. On a trip to see me, proposed to her. Filed for K1 visa. Painful waiting, mixed with expensive trips back and forth 3 months at a time. Finally approved. More waiting. Interviewed. Approved. Visa in hand just now. Traveling back to US on visa June 27th. Plans to marry August 23rd in Hawaii. (can't wait :D v) Which brings us to my question.

From the day we get back, we will have 27 days to send in all of our paperwork. I want to have everything finished before we even go to Hawaii, so when I get back I can just add the marriage certificate and send it off. The question I have is, what forms do I need to prepare to submit? And is 27 days to file enough time? I'm afraid of time constraints and snail mail service. I read that I need to file for AOS, or EAD, or AP... So many acronyms... :wacko:

Any help is greatly appreciated. Thanks in advance!

What do you mean, you'll have 27 days to file the paperwork? You do not need to file the AOS within the first 90 days of being in the US, you only need to get married in that time.

For AOS? You have no deadline; however, the sooner the better.

The marriage in 90 days is the only deadline you have to meet. You'll have met it, and you can file AOS whenever you're able to. The sooner the better.

Technically, wouldn't the deadline to file AOS for K-1 visa is the expiration date of I-94? If AOS is not file by that time, then the fiance(e) would be "out of status", isn't that correct?

No. There is no deadline to file for AOS. Yes,once the I-94 expires, then they will begin to accrue overstay and be out of status. There is a small remote chance they could be detained, but would not be deported because they are eligible to file for AOS. However, there is no actual deadline given to file, and many people file a few weeks or months after their I-94 expires and have no problem in doing so. Once you file the AOS, you enter a period of authorized stay and the overstay clock stops. When your I-485 is approved, the overstay is forgiven and no longer matters.

The foreign spouse cannot work, get a license, go to school, or travel outside the US and re-enter without filing for AOS and getting their EAD/AP or green card. Because of this, it is best to file as soon as possible.

Thank you everyone for the help! I wish I would have known about this site at the beginning of the process, I could have saved myself a lot of money and stress... I hired a company to do the paperwork for me because I was worried about getting something wrong. I actually believe my case would have gone by faster if I would have done it myself. *sigh* Live and learn I guess. Anyways, good luck to everyone else! My baby flies back to me the 28th with her visa in hand~~ Woot woot~
