Thats the thing though.. it's not forgiven. Overstays are forgiven. Breaking the law, not so much.

Maybe it doesn't bother you, but to the rest of us who had to deal with all this immigration ####### to come on here and flaunt "look at me, i did everything the wrong way and STILL got approved", it's a bit infuriating. There are people on this forum who havent seen their spouses in a long time because of immigration.

abusing a system that the rest of us are trying so hard to understand and follow properly, and legally... it's disgusting.

Either way, I think I'd place the blame more on the NY office and that IO, since they clearly dropped the ball on this one. People will always sleaze their way into whatever they can get their hands on.. its up to the people put in place to enforce the laws to make sure they don't get very far.

I don't agree with the OP, or trying the look for an excuse, but those who are working illegally and overstaying ARE breaking the law, too.... It's just considered less of an issue and forgiven.

I'm not saying that I think it's ok she worked illegally. I'm actually very much against that particular crime. But, had she come here before she filed and said "I've worked illegally, what do I do?" Everyone here would have said "whatever you do, don't lie about it." And that's what she did, she filled out her paperwork honestly. Now that's she's approved and excited about it, people seem to be saying "we wish telling the truth would have got you deported". And, "we hope it gets you deported in the future." Does that make sense?

She's young, she might have a disagreeable personality, but I don't see why everyone's so angry at her.

If I went to another country and worked illegally..and then eased by immigration by some miracle of luck...I wouldn't post it on a public bulletin and NOT EXPECT people of that country to be angry. :bonk: It's not unreasonable in the least for people to be angry, especially those of us who know that breaking the law is not cute. :no:

Oh, I'm angry at every illegal immigrant here. Especially the ones that work illegally. But I think it's hypocritical when people here advise people every day that it's ok they worked illegally, as long as they're honest about it. And now those same people are saying they wish she was deported.

I didn't think she was trying to brag that she got away with something. I think she was just happy and wanted to come on here and yell "love conquers all." Of course she's wrong, but whatever. Let her have it. If there's consequences to be suffered, I'm sure she'll suffer them eventually.

YES IM FREAKING SERIOUS!!!!!! there's plenty of people who admits working illegally and with made up SSN and still got their GC!!! it's a FACT!!!!!! it is forgiven if you marry a US citizen. yes she admitted it to USCIS and didn't try to hide it and if her employer checked the citizen box then yes she's in a lot of trouble but I'm assuming they didn't. seriously it's over and done with.. why cry over spilled milk. more power to everyone who's going through this process the legal and honest way.

Partly. Working without authorization isn't held against someone who is adjusting status as an immediate relative of a US citizen, just as being out of status is not held against them. On the other hand, there is absolutely nothing in INA 245 that even remotely insinuates that I-9 fraud isn't held against them.

On the upside, employers do not turn in completed I-9 forms to the government. They are required to keep them on file. If the government is suspicious that an employer is knowingly hiring people who are not authorized to work in the US then ICE will conduct an audit of the employer's I-9 files. The OP's admission to the IO at the interview may be just enough to trigger an ICE audit of her previous employer. If her employer still has her I-9 on file then both her and her employer could be in deep doo doo. As long as that I-9 form exists it's a potential time bomb.

Go to ice.gov and do a search for "I-9 fraud". It should be enlightening.

A huge number of honest employers don't fill out I-9's correctly. I'm guessing if her employer was so unscrupulous that they just made up a SSN, they probably didn't spend a lot of time filling out the I-9.

I'm all for busting employers like that, but I have my doubts that anything will happen to hers.

? You falsely claimed to be a US Citizen with a made-up SSN?

I'm not trying to justify the processing of this case but "Made-up SSN" doesn't equal "Pretending to be US citizen" because an alien can get a SSN. It sure is illegal to make up a SSN but those are two different things.

I've had a (real) SSN for 7 years. Got it while on a non-immigrant visa (student). A made-up SSN doesn't equal claiming US citizenship, it just means claiming an immigration status you're not entitled to. It's illegal, sure, but not even close to being equal in rammifications as a false claim to US citizenship.

You are right that one doesn't necessarily equate to the other, but if you get a job based on some I-9 combo such as "SSN and license," then I think you are claiming to be a citizen, because as far as I know that combo for work authorization only works for citizens.

Plain old vanilla illegal work is forgiven for spouses of USCs, where someone says to an employer, "hey, I am not legally employable, will you hire me?" and the employer says "okay!" But faking a SSN is a whole other crime, the details of which were outlined earlier. It is not okay and not overlooked, because the potential ramifications are severe.

I am not sure what is fraud here. She did not claim to be a US citizen. I do not think the way the OP went about things was the right one and it is frustrating to read the boasting, but I don't think that implying we should report the OP for fraud is a smart thing to do :wacko:

No implication. But a number of people in this thread have stated that they believe the OP has committed fraud. If they truly believe that there is fraud and have something to back it up and are not just frustrated at the OP's actions then there are the details if they wish to report it.
