I've heard of cases where somebody on a visa (who has a real SSN) filed their taxes as a USC, but otherwise never claims to be a USC (not on the I-9, employment applications, etc etc).

Personally I dont have an issue with that (theyre paying their taxes like everyone else... which is more than you can say for a lot of the people in this country).

But in this case, orangedesk said it best. It's a slap in the face.

She admits her employer made up an SSN for her and she admits to working illegally. If the employer put US citizen on her I-9, she's in a LOT of trouble.

YES IM FREAKING SERIOUS!!!!!! there's plenty of people who admits working illegally and with made up SSN and still got their GC!!! it's a FACT!!!!!! it is forgiven if you marry a US citizen. yes she admitted it to USCIS and didn't try to hide it and if her employer checked the citizen box then yes she's in a lot of trouble but I'm assuming they didn't. seriously it's over and done with.. why cry over spilled milk. more power to everyone who's going through this process the legal and honest way.

OP doesn't realize that the process or journey is not yet over. Eventually when she tries for a change of status she'll get caught and eventually deported. Why would you come to this forum where persons are actually trying to help eachother with legitamite questions. Please update us on your journey as you will be an example of someone who has committed fraud and the repercussions that you will go through.

Thats the thing though.. it's not forgiven. Overstays are forgiven. Breaking the law, not so much.

Maybe it doesn't bother you, but to the rest of us who had to deal with all this immigration ####### to come on here and flaunt "look at me, i did everything the wrong way and STILL got approved", it's a bit infuriating. There are people on this forum who havent seen their spouses in a long time because of immigration.

abusing a system that the rest of us are trying so hard to understand and follow properly, and legally... it's disgusting.

Either way, I think I'd place the blame more on the NY office and that IO, since they clearly dropped the ball on this one. People will always sleaze their way into whatever they can get their hands on.. its up to the people put in place to enforce the laws to make sure they don't get very far.

My best guess is that the USCIS approved the I-130/AOS only because she has not been arrested nor convicted of any crime thus far. It would have been a much different outcome had the DOJ prosecuted and the court convicted the OP of I-9 fraud, using false documents to be employed, misusing a social security number, making a false claim of resident alien status, using false documents to defraud the U.S. and/or possession of such false documentation. You could then have bet your bottom dollar that had the OP subsequently declared such arrests and convictions on her application that such crimes would not have been forgiven, in fact, she would have likely been told that the nature of crimes make her permanently inadmissible to the United States, her application would have been denied and she would have be detained on the spot.

Again, these crimes are not forgiven, not even for spouses of U.S. citizens-- but until she is convicted of them, the USCIS nor ICE do not have the jurisdictions or authority to deport her without due process. It is up to the State or Federal prosecutors to bring such charges against her and if/when convicted only then will she incur the immigration ramifications of her actions.

I don't think anybody here is "crying over spilt milk"-- personally speaking, we don't have to live with the consequences of always wondering when the DOJ will press charges and nor do we have to live with insecurity of building a life in the U.S. knowing that at any moment it could all be taken away due to her foolish actions and after having spent the last three years living in the U.S. illegally myself, I can tell you that this fear is very real and the fear of someday being caught and always having to look over your shoulder at every turn is probably a worse punishment than being convicted, serving out the sentence and then carrying on with your life. The OP has made her bed and if she doesn't want to consult an attorney to attempt to sort out this mess sooner, then later she will need to lay in the bed that she has made and no amount of "playing it up" will save her.

Federal taxes don't ask if you are a USC. Non-USCs who work in the US and LPRs who work abroad are required to file taxes as well, so filing with a real SSN (whether for legitimate work or under the table work) is NOT the same as claiming to be a USC. No idea if some states ask if you are a USC in filing taxes but the ones I have filed in (Maryland and Virginia) do not.

It's all very well slamming the sleazy foreigner for what they did but they took their lawyer into the interview, presumably a USC ?

She forgot her passport, simple as that, not as someone said touching his sleeve was more important than remembering it.

I didn't read it as advice given to anyone, it's an account of their experience, however unwise it was to post here.

According to their timeline the interview was 17 days ago, I wouldn't call that rushing online to boast about it.

Got very lucky on that particular day is all.

She's young and exuberant, naive and happy. I don't think she was trying to announce she got away with something. She told the truth on her paperwork and it doesn't appear to have hindered her AOS.

I don't know that she really deserves some of the more vicious comments here. At least she told the truth.
