I think I have truely screwed up. My wife and myself have 2 boys in the Philippines that we really want here now. They are my stepsons. I thought I was doing a good thing by letting her file for the when she got her legal residence. Im finding out now how wrong I was. We just got the letter stating it could be years of waiting. What is my recourse? We have both of their WAC numbers and received notice from the NVC of the waiting list. My question is can I refile in my name and Im a US citizen born here. Any help will be greatly appreciated.

If you didn't file an I-130 for the step-child already, you need to file one concurrent with the I-485. The box checked is "Child".

My wife who is a legal resident filed with my blessing already and now we may have to wait years for a visa to become available. Thats what Im trying to solve.

10 years and 8 years old. Will it be easier if I refile the I130 on the boys in my name. I don't mind spending the money to refile. I screwed up. I just want my sons here in the shortest time. Ive already wasted a year.

I think as USC it will definitely be quicker since the boys are minors. Research it on the USC website.

Why weren't the boys included on the original filing for her? They should've been.

The boys didn't want to come at that point and I got really bad advice from the agency that handled my wife's paperwork.

You, the US citizen, should refile the I-130 for the boys (2 separate forms....2 separate everything for that matter. Treat them as separate cases right down to the payment check, but send it all in one package). They'll be here (if all goes smoothly) in less that a year.

You could call uscis and cancel your wife's petition, or you could just let it die out.

Provided your wife was not married to their biologic father, your wife has sole custody. Permission from the biologic father is NOT required.

I should have came and joined this Forum in the beginning. It would have saved me alot of time. Im going to file the I-130 in my name asap. Can anybody give me a timeline to expect? It could be anywhere from 7 - 9 months. Possibly more if there are complications. But do it now!!!

I would estimate 5 months at uscis. During this time you should read the Ling Che NVC shortcuts on this website. Do as she says and be prepared for NVC before it gets here. If you have everything ready for NVC it should take 2 months from start to visa. Add in an extra month just to give you some breather room. We're looking at hopefully less than 8 months.

Of course, that would be if everything went smoothly! I'm rooting for ya! I LOVE why I see someone fly through the process!!!
