My K1 was aproved last week, but my 7 year daughter K2 is pending cause there is a valid claim to US citizenship and the CO told me she is not eligible to apply for or receive a visa to the United States because a US citizen does not require a visa to enter the US. Im totally agree with her, they may insist on a CRBA instead but how am I going to do CRBA her father does not have any contact with us since she is 1 he sign his right away :( and I cant do this process my self what are my options I dont want to leave my daughter behind Im debastated I dont know what to do they said her case is going to be open for 90 more days.

Do you know where the father is? Did you look for him on Facebook etc?

Is he on the birth cert?

If that's the case, your daughter should be able to get a U.S. passport. I had the same problem with my sister. My sister had no problems getting a U.S. passport as long as you have all the requirements. Some fall into the trap of paying for applications when their children are already citizens. What sucks is the fact that you cannot get a refund.

1/18/2013 - Married

3/5/2013 - Filed AOS, EAD & AP

3/7/2013 - USCIS Chicago rec'd applications

3/12/2013 - USCIS sends NOA1 email

How did she get a US passport as I understand the US citizen parent is the one who has to sign the CBRA form in my case I dont have any idea where he is at in the US I sent him emails but no response today I sent one to one of his relatives to see if they can help
