Hey guys,

So we had applied for GC on 13th April and sent all the forms. As of 6/10 I got my EAD approved and got it on my mail yesterday. What happens next? And how much time.. any ideas?

Also, we had submitted form 864 showing that my spouse can support me, however she has been having a hard time at her job and wants to quit and look for something part time... can that affect my GC process and if yes, how and what should we do?

p.s - I already have a job and have submitted my pay slips and W2s to USCIS as well.. I'm on a H1B visa as well, now along with an EAD

Your job will not help in this situation. If your wife planning to quite and find part time, you most likeley will need a co-sponsor for the interview. If you can't find a co-sponsor it is better to suffer and wait till you get a GC before switching jobs.

Actually, your job can help. If the immigrant is legally employed and the job will continue from the same source after GC is approved, then your income can be added to your wife's I-864. Did you fill it out that way (you say you sent in W2s so I think yes)? If you did, do you as a family still qualify without her income?

Oh, then why submit your paystubs and W2s?

Okay, well if your income is above the poverty line, then I would prepare a new I-864 and bring it to your interview.

You will have a mandatory joint interview (You are not a K-1 entrant) so I would bring the updated one then. It will probably slow your case a little and delay approval after interview.

Or your wife can keep her job for a few more months.

If your combined incomes will be enough to cover the 125% for your household size when she starts working part time, then she could go ahead and do that now. You could bring a new I-864 with all the new supporting documents to your interview. If her quitting to work part time will not add up to enough to meet the 125% requirement when combined with your income, then she should probably wait until after your interview and green card approval to change anything employment-wise.

Cool.. this helps... Yeah, its should be above 125% after she quits and gets part time..

Any idea how much time till interview and approval of GC, considering I got EAD as of 6/10 and applied on 4/13?

It is hard to say. It will depend on the backlog at your local USCIS office as to how soon you will get your interview scheduled. The average time it takes is about 4-6 months from filing.
