When can I apply for Advanced Parole?

I checked online and my I-129F was just approved for the K1 Visa for my fiance. They mailed the NOA2 on Friday and I am expecting to receive it in the next day or two.

One of my big concerns is that we wanted to travel outside of the United States for our honeymoon. From what I am reading, you are only allowed 1 entry into the US with the Visa. And that I will need to apply for and receive Advanced Parole before leaving the US. Otherwise, my fiance will not be able to get back in. But I am still unclear on how the whole Advanced Parole works.

When can I apply for Advanced Parole? What do I need to apply for Advance Parole? How/where do I apply for Advanced Parole?

Thanks all for the feedback!

You cannot apply for the advance parole until you get married. You apply at the same time as the AOS paperwork. Also do your EAD at that time. The AP and EAD are free to file when your pay for and file the AOS. You're going to have to delay your honeymoon by a few months to wait for the AP and EAD to get approved. If you want a honeymoon right after the wedding, you're going to need to stay in the USA.

You could make an infopass appointment at your local USCIS after the Advance Parole is filed to ask for expedited parole. Problem there is trying to make travel plans without knowing for sure. Safer course of action is honeymoon in the US.

Thanks for the feedback. Looks like we'll be applying for Advanced Parole the day after we get married.

But I am still a little about Advanced Parole and Info Pass.

What exactly is InfoPass?

Do you need to provide a reason or emergeny for Advanced Parole? Or only for Info Pass?

What is considered an emergency reason to justify an Info Pass?

Are Advanced Paroles every denied and why?

Thanks all!

Time to read the guides and instructions in the forms: http://www.visajourney.com/content/k1k3aos

Infopass is an automated system allowing you to schedule an appointment with USCIS concerning your pending application. Good luck!

US citizen since April 2016

ROC completed April 2014

AOS from K1 completed February 2012

You file for Advanced Parole with the AOS packet, so it'll probably take you a little longer than the day after to be able to do that. Once it's received, you can make an Infopass appointment and ask for it to be expedited, but they don't usually do that except for emergencies. Otherwise it's a 2-3 month wait. I would look into postponing the honeymoon or going to a nice, US-bases spot like Hawaii.

What do they consider emergencies? Is there a list of accepted emergencies somewhere?

Death in the family, a serious illness that will probably lead to death, pending military deployment, USC spouse being transfered overseas for work, etc... are the types of things I've seen work. It appears to be up to the discretion of the officer from what I've seen.

Wanting to take a honeymoon out of country will not be considered an emergency. Although you might get someone who's nice and say OK, thats a good enough reason for me, but I wouldn't put money on it.
