I just read the RECORD OF SWORN STATEMENT THING .... THE PAPER THEY MADE ME SIGN, AND THERE IS A PART THAT SAYS :

YOU WILL NEED TO OBTAIN A NEW VISA PRIOR TO RE-APPLYING FOR ADMISSION TO THE U.S.A , DO YOU UNDERSTAND???

SO I GUESS THERE IS A BIG CHANCE FOR ME TO RE-ENTER THE STATES ON A DIFFERENT VISA?? BC IT DOESN'T SAY ON THIS PAPER THAT I'M BANNED FOR "X" PERIOD OF TIME.... AM I RIGHT???

You asked for an answer but did not supply all the information. If you want a good answer you need to supply good information.

It appears you were deported and you also have some inadmissability issues. Which means IF you could get a visa you could come back but there is almost no chance of getting a visa in the near ( like next 5-10 years) You might qualify for a waiver if you were the spouse of a USC. But currently you aren't looking at travelling to the US for a very long time.

This will not be over quickly. You will not enjoy this.

After reading all the extra information you have now supplied, I think you need to get an immigration attorney to consult with about your case. If your K-1 is denied, they will let you know if you are eligible to file for a waiver or not. Seek the advice of a knowledgeable immigration lawyer.

Applying for a visa is one thing, being approved is a different matter. People ask questions so you can get a more precise answer rather than guessing what the odds are of you having a ban or not.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

To the OP - Just use the info here as a guide and opinions, not facts.... You didn't give all the info in the beginning and its easy to get confused via e-mail, thread, meassages. ect...

From the record of sworn statement you just submitted to us, it tells you that you will need to get a new visa before coming to the U.S> K-1 is a new visa, either apply for the K1 or get married in Mexico and go another avenue... Or live in Mexico as you stated could be an option..

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

From the way she wrote, I think most members thought the government paid for her ticket, not her boyfriend- ie that she was deported.

The govenment apparently paid for her ticket when she left, which means they officially deported her, which means she has a ban for the deportation. She said she didn't buy the ticket and wasn't allowed contact with the BF when she left. The assumption become that we taxpayers paid for the ticket.

This will not be over quickly. You will not enjoy this.
