Child Support and family size on affidavit of support

Hi all,

My husband has his interview next Monday. I've been searching the forums for family size on the affidavit of support. My three stepsons will stay with their mother in costa rica. When we both have enough income we will see about sponsoring the kids. Here is what I am reading and it confuses me from the directions for I-864:

Can a petitioner (sponsor) with limited financial resources sponsor only the principal applicant and not his/her spouse and eligible children?

Yes, the sponsor can limit the number of sponsored immigrants to the number of people who actually intend to immigrate at that time. The principal applicant must be one of the sponsored immigrants. The petitioner can reduce his/her household size by limiting the number of sponsored applicants. This reduces the minimum income requirement. The sponsor can file another Affidavit of Support for the principal applicant's dependents later when the petitioner and the principal applicant have more income. The principal applicant and any of his/her family members who may have already immigrated must be included in the household size for the new Affidavit of Support.

How do you count children of a divorced couple who reside with one parent part time?

A divorced parent's dependent children are members of his or her household, even if they live part of the time with the other parent. The child is a member of both parents' households on an Affidavit of Support unless a parent proves that he or she has no legal obligation to support the child.

Maybe the second one doesn't apply since they were never married and therefore never divorced. I think we're fine but I could use some input. I think I am over thinking everything. I'm going kinda crazy. I did have help with the affidavit from the law school so I should be fine and I will call them tomorrow. THANKS IN ADVANCE

A sponsor must include in their household count minor children no matter where they live.

Ok so, I am the sponsor and I included our daughter, my only dependent, but do I include his three minor children who will not immigrate at this time?

No, you do not include his children unless they were immigrating with him. A sponsor would have to include children of the divorce even if they don't have physical custody. Since you are the sponsor, you only include your dependents & the sponsored immigrant in household size.
