Hi all- upon arrival on a k-1 visa got fiancée a ssn in her maiden name. Got married and went to ss office to change name but told could not because I-94 was expiring under 14 days. Wanted to change name before filing AOS. Any suggestions on how to still make name change or extending I-94 so can file her AOS in her married name?

Put her married name on the AOS application and be certain to include her maiden name in the 'previous aliases' section. USCIS understands that there are difficulties in changing names with limited identification and expired I94's, especially with K1 visas. The name you put on the AOS application will eventually appear on the green card. So make sure you choose wisely, otherwise you'll have to file for a name change on the green card and that will cost you $500 and months of waiting.

Best to do it up front even though you're still attempting to finalize the change.

Just go ahead and file for her AOS in her married name. The SS card does not need to be changed first. When she gets her green card in her married name, go to the SSA to change her name. Her new card will then come in her married name and without the work authorization notation which is not needed when you have a green card.

If she's married, and has chosen to take your name, then her name is already changed. SSA doesn't determine what her name is. They will need to be updated of the name change, but as you've found out, they won't update the card without the EAD or GC. She can file AOS using married name right away, and then use the EAD or GC to update name on SSN card.
