Hi,

My husband got sick and wants to return home to seek medical help and then return back to the USA. The only problem is that he wasn't received his green card yet. We filled for the K-1 visa, but we did not file that form in case you need to return back home before your card arrives. What is that form called and how will cost to file it now?

It is called Advance Parole, form I-131. It is free if filed based on a pending I-485. It does take about 3 months to be approved, but you can try to make and Infopass appointment and get an emergency one issued, if his condition is severe. Bring proof of his illness.

Yes. If emergent Make an info pass print it and head to uscis with all supporting documents (don't wait til appointment date they will understand is important)most likely you'll get approved on the spot.(personal experience)

Also write a letter requesting to expedite your request . Good luck hopefully you get it approved.

06/20-(day 20)- Email received (Saying error fixed)

07/13-(day 43)Email: reused most recent biometrics, awaiting Indie status

09/10-(day 103)Humanitarian Expedite Request

9/13-(day 106) Interview October 17TH (TOTAL 139 DAYS)

9/17-APPROVED ON THE SPOT AND STAMP ON PASSPORT WHICH EXPIRES IN ONE YR!!!
