Hello Everyone,

I am new to this site and have a few concerns and questions regarding bringing my fiance to the US on the K1 Visa. I am so unfamiliar with this process, terms and conditions.

I met my SO back in 2006 but been in a relationship with him for a little over 2 years. When we started our relationship we were in a long distance relationship for over 6 months until I decided to move to our country Dominican Republic. We maintained our relationship until I return back to the states after 1 year and a half. I am a little confused as to which visa to apply to but I leaning more towards the K1.

Now I am back to the states and would like to bring him here but not sure under which visa, either the fiance or spouse one. We are not married yet but plan on it just not sure which method is the best one. If I was to apply for the K1 visa, how long will it take for him to be in the US, if approved? What are the requirement? I know we have to marry within 90 days from his entrance to the US.

Sorry for so many questions. I am soooo clueless with this process that I need all the help I can receive.

If you are not currently married, then the K1 Visa is the way to go. As far as proof of a relationship, pictures, phone records, Skype logs (its what I used), travel itineraries, airline boarding passes can be used. This site is very helpful, where most if not all of your question could be answered. Before starting the process you should familiarize yourself with the forums if you are looking into the K-1 visa, If you go to the tab forums there you will find the step and guides to help you with the process.

As for your questions

If YOU the petitioner do not work you should find a co-sponsor who does work.

As far as employment goes as long as you are in the poverty incomes guide line and have financial resources and your tax return transcripts.

Requirements pictures, cell phone bills, boarding passes, hotel stay, stamped passport entry, chat logs, emails, anything showing proof of your relationship and as you mentioned above you moved over there which shows you spend X amount of time living out there with him...

Again if you familiarize yourself, with the site you can check out other profiles, of people who have done the K-visa in the Dominican Rep. and how there interview where held and question that where asked to the couples.

The K-1 visa is good if you want to start now and marry in the US.

If you want to marry in DR, then it is not good for you, because the K-1 requires that you marry in the US. Also, the K-1 is a non-immigrant visa that allows for immigrant intent. So after you are married, you will have to apply for adjustment of status to get his Greencard. This is expensive ($1070) and he will not be able to work or travel outside the US for a few months. If it is important that he be work authorized right away, then I would consider the spousal visa.

Just to be sure you don't confuse:

- petitioner= US citizen, you

- beneficiary=him, the one who get the visa

The first step in the K-1 visa process is for the petitioner to submit a I-129F petition. It takes about 4-6 months for it to be approved. Once approved, the case is forwarded to the National Visa Center (NVC) where they log your case into a system, assign a case number relative to the beneficiary country, and then forward the case to the beneficiary's country US embassy. Once the case is at the embassy, they contact the beneficiary and that's the actual step where he can apply for the K-1 visa. Depending on the country, it takes from a month to several months.

The financial docs are involved at the embassy stage. Nothing is required by the beneficiary, but he needs to be sponsored in order to prove that he won't become a public charge once in the US. The primary sponsor is always the US fiance. If you don't make enough money (below the poverty guidelines), the beneficiary needs a co-sponsor.

If you apply for the K-1 visa you must not already be married. If you apply for the K-1 and you aren't working then you need to find employment that pays 125% of the poverty level. Poverty Level Guide

If you cannot do that then you will need a co-sponsor who can meet these requirements. You do not need to be employed for any specific length of time, your partner needs to be able to produce your wage stubs at the time of their interview though. Along with the last 3 years of your tax transcripts.

The interviews vary depending on the consulate.
