I was pondering the same question !

We are both older , have been married before and don't have family except my 3 grown children.

No siblings, aunts, uncles or cousins........noone here in the US, just friends and church members.

We have submitted emails about wedding ceremony planning with my petition

and those are in the embassy stack as well for the interview.

If we now just have a civil one instead a church wedding, would we have AOS problems

because they always want to see wedding photos with family etc......we did submit

the emails where we discussed the whole wedding and reception.

I would have liked an October wedding but the way it drags on and on we would be

making snowangels after the wedding...brrrrr....so cold, and I am tired of all the stress.

Thought about a civil first and church wedding later but I am almost convinced

to just do the civil one and forget the other.

It is too bad that this has taken so long and a middle in the winter wedding just doesn't appeal to me.

I am way too STRESSED OUT to worry about a big wedding now. A wedding in spring is too far away.

We just want to start our lives together under one roof.

The kind of wedding you have has absolutely no bearing on your AOS approval.

The only requirement is that you get legally married within 90 days of entry to the U.S. Not where and how you get married. As for AOS, they are mainly concerned about a valid and legitimate marriage, not how fancy your wedding was.

Really, all they care about is: did you get married in the time frame you were supposed to, and are you living in the same residence and continuing a legitimate, ongoing relationship.....and can you prove it?

That said, read Cassie's reply closely. If you do not provide the evidence they seek, then your chances of being denied are greater.

there's only need for one. And that's the legal one. If you've got the marriage certificate, and your marriage is for real (ie: not just trying to get a green card and you'll leave your spouse once that is rec'd) then you should be fine.

James and I got married at the magistrate's office. She didn't even ask to see pictures at our AOS interview. Your mileage may vary of course.

The answer should be NONE.

I say this because marriage is a STATE definition and not a FEDERAL definition. In simpler words, the federal government cannot decide if a marriage is legal or not. Only the state in which you reside can do this.

The word marriage is not in the Constitution nor Bill of Rights, so therefore a legal marriage is up to each State to define (which they all have done). The IRS goes this route, but that does not mean all federal departments will see it the same way.

Of course, this won't stop federal civil servants from passing judgement on you, but they have no basis for deciding if a marriage is legal or not because only a State government can do this. If you have a valid marriage certificate and this is questioned in an interview, I would just say that this is a valid marriage in this state. I wouldn't get in an argument about it! If they want to argue, ask to speak with their supervisor and end the discussion, but it shouldn't come up.

DHS doesn't pass judgment on the legality of your marriage. They simply ask you to provide the legal proof and they won't even schedule your interview until you do.

What they do pass judgment on is whether or not the marriage is bonafide.

We did a civil wedding and Claudeth had her GC five months after we filed the AOS.
