I was under the impression that someone who entered US on a CR-1 visa after marrying a US Citizen will have to renew his/her green card. In my case, the green card is valid for two years after data of entry to US. So do I need to file for renewal of green card (form i-90) or file for removal of conditions (form i-751)?

10-05-2010: Visa Received.

If the greencard is a 2-year greencard, the person is a conditional resident, and must file I-751 to remove the conditions in order to obtain a 10 year greencard. This is based on being married for less than 2 years at the time of gaining resident status. Once the person has a ten year greencard, then the I-90 must be used to renew. In your case it is the I-751

Another quick question: Do I need to apply within the 90 day period before expiration of the green card or can I apply before the 90 day period?

hi-

It is my understanding from my lawyer that you have to file within the 90 day expiration period. We saw her back in February of this year, but she told us to come back at the end of April. (GC expires end of July, 2012)

We submitted the forms about 2 weeks ago.

You have to file within that 90 day window. If you file before that time the package will be returned to you unprocessed and with the statement that you were not yet eligible to file. You also don't want to file late because if it is late, it is up to USCIS whether or not they will accept it, and generally you need to include a letter of explanation stating why you did not file on time. You can certainly get all of your evidence together before the 90 day window, and then mail it when the 90 day window opens. Don't mail it early hoping that it will get there on the first day the window opens - it might arrive a day early in which case it would be sent back. They are very specific about filing within the 90 day window prior to the expiry date on the 2 year green card.

For the tax returns: Fed tax returns are fine or do I need to send state tax returns as well?

I am sending in only 2010 and 2011 tax returns. Are two years enough?

How many bank accounts statements would be enough? 4,6,8???
