Hi all, Please help me on this one as I am almost frustrated to death.

I graduated from a college in CA in May/2012 with F-1 visa and had a job offer which will start on 7/9 [Today is 6/17]. However, My Intl-House forgot to mention me that I have to apply for EAD within 30 days after obtaining OPT I-20!!! So I won't have EAD on the first day of work, and if this happens, my HR said I will be fired!!!!

There are a few points here:

- I have obtained a OPT I-20 in March.

- Did not apply EAD within 30 days, and still has not applied for EAD yet

- Grace period ends on 7/11. Which means I have to leave states before that?

- CHANGE OF STATUS H1-B has approved, but I cannot leave the states until 10/1 in order to make it effective

Questions:

- What should I do now to expedite the EAD application process

- Can I get a new OPT I-20 with a new date?

- Do I must leave the states when the grace period 60 days ends? [i think it is impossible to get my EAD card by 7/10]

- What is the best way for me to keep staying in the State while waiting for the EAD card after grace period?

- Is there another way to obtain EAD or other status quickly?

THANK YOU SO MUCH!!!!! I really don't want to give away this high salary job and leave the States so that I cannot recruit!!

The I-20 itself is of no use, unless you have an EAD and there is a time limit after which you graduate within which you must have applied both for your I-20 and EAD. Your international students' office will help apply for your EAD and once you get the EAD, you have three months to get yourself a job and then re-apply for a new I-20 with your employers' name on it. This is what is called the OPT I-20. So, I am not sure what you mean by you have the OPT I-20. From what I know of the process, you need the EAD to even apply for a job, leave alone get a OPT I-20.

Am not sure what your school has advised you, but if you did not apply for your EAD within, I think, a month or so after your graduation, the process is null and void. Talk to your international students' office and see what solution they offer. At the moment, as far as I know, there is very little you can do, but perhaps some other VJ member who is more aware of these matters has better advice to offer.

Arrived on F1 visa on 25 Dec 2008. Graduated June 2011. Started OPT Sep 2011.

AOS applied March 21, 2012. GC approved June 11, 2012 & received June 18, 2012.

Exactly three months from start to finish,no RFEs.

AOS Timeline:

Day 01,March 21, 2012: Concurrent filing of I-130/AOS/EAD/AP to Chicago Lockbox

Day 02,March 22, 2012: Package delivered to Chicago Lockbox

Day 04,March 24, 2012: USCIS Acceptance Confirmation received through e-mail

Day 07,March 27, 2012: Checks cashed.

Day 13,April 02, 2012 : NOAs received for I-130,I-485,EAD/AP & Biometrics

Day 36,April 25, 2012 : Biometrics Completed at Elizabeth, NJ.

Day 45,May 04, 2012 : E-mail notification for interview received for June 11

Day 46,May 05, 2012 : Received hard copy of interview notice

Day 56,May 16, 2012 : EAD/AP Production e-mail

Day 64,May 24, 2012 : EAD/AP Card in hand

Day 83,June 11,2012 : Interview. Approved same day. Card production email.

Day 84,June 12,2012 : E-mail Notification registering PR status.

Day 87,June 15,2012 : USPS picks up GC from USCIS.

Day 88,June 16,2012 : Received two hard copy mails, approving I-130 & I-485

Day 90,June 18,2012 : 10-year GC in hand. End of GC journey, for now.

The DSO at your school might be able to fix this. Contact him/her face to face, and see what's up.
