My Wife is a US citizen who was born in a foreign country, she has US passport, Driver's license and Social Security Card, everything except for Birth Certificate.

We just noticed that the interview notice says, bring petitioner's birth certificate, the problem is we cannot get her certificate now. And the interview is in 3 days.

My questions is:

Must we bring US citizen's Birth Certificate to the interview? Can we just bring U.S. Passport as a proof of citizenship? Thanks...

Are you sure it says petitioner's birth certificate or beneficiary's? If it is the petitioner's, didnt you submit one fore the I129?

Our interview notice definitely said:

Your birth certificate

Your petitioner's birth certificate and your petitioner's evidence of United States Citizenship or Lawful Permanent Resident Status.

Why no birth certificate? Not even a copy?

I do think that proof your wife's citizenship is more important for the interview.

Not sure when the interview is scheduled and whether you have anytime to remedy this prior to the interview.

Maybe just explain to the IO during?

I had a few things missing, original I-94 (had replacement with me) and previous EAD (just long gone don't know where it is), original passport I entered with (also long gone).

Our IO was very understanding :)

Sometimes things are lost and you just don't have it.

Good luck!

For AOS, the immigrant is the petitioner - the immigrant is the one petitioning for the Adjustment of Status.

Yeah, both the notice says birth certificates twice, no matter which is which anyways.

I agree with Malagasy, this is about the petitioner. The citizen brings a DL and passport, they never asked for my USC other stuff. Also a copy of everything you submitted and more photos etc.

In Arizona its hot hot hot.

For AOS, isn't the immigrant the petitioner - the immigrant is the one petitioning for the Adjustment of Status.

No. The USC is the petitioner/sponsor, the immigrant is the beneficiary/applicant. The AOS is based on the USC's petition for their spouse/fiancee. For K1 adjusters this is the I-129F approval, for those AOS from visitor etc it's the I-130.

You can't agree with "Malagasy" and then say it's about the petitioner. The USC is the petitioner/sponsor, the immigrant is the beneficiary/applicant.

That said, this is a standard interview letter, passport is typically sufficient.

Nope.

For AOS, the US Citizen is the PETITIONER [for the immigrant]. The immigrant is applying [is the APPLICANT] to adjust status.

It is good to take the original birth certificate and copy of both the petitioner and beneficiary. If you don't have the original, you must take the copies with you. It is one of the documents that the officer asked us to present during our interview.
