Criminal History?

I just saw this article for the NY times my question is what is considered crimial history? My fiance was recently pulled over for speeding and then because he does not have papers was arrested for driving without a license. He was taken to immigration in atlanta, ga but they let him go after about an hour because he has been here since he was two and has a clean record....also they got him onfused with someone else. That was the first time he had ever been pulled over does anyone know if something that minor would make him uneligible for this new act that has been passed or know where I can find that information?
