Hello there.

I came to the US with a tourist visa 5 months ago to visit my boyfriend. we got married a week ago.

I was reading something about going back to my country and send the I-130 so i would avoid denial, deportation, or even being banned from re-entry to the US.

I know people that they just sent the l-130 from here and everything was ok.

I Dont really know too much about all this, so I'd appreciate if you guys help me out :)

Your husband will have to send the I-130 from the US, unless he lives with you abroad. I'd be cautious if I were you--we were told before marrying that getting married in the US while he was on a tourist visa might make it look like my fiance had entered with the intention of marrying, which USCIS doesn't like. I think it's possible that foreign-born spouses who marry while on other visas can adjust their status within the US, but if you've been there for five months "on vacation" that might raise some red flags.

Timeline

you have to return to your home country, before the b/2 1-94 expires.then file 1-130 for spouse.read the guides on top of this page,get togather a lot of evidence of bonafide marriage,do research look at the example forms,1-130 - cr-1 .
