hi,

my mom filled the i-130 for me in december 2010 and it been aproved through USCIS now it at NVC. Well i called the NVC today to follow up on it and they saying it under eview for the child protection act...what does this mean?how long does this review take?what steps can i take from this point?

P.S: i currently have an F1 visa and am in the US at the moment does this affect it?

It's Child Status Protection Act. They're trying to determine what visa category you fall into - minor child or adult son or daughter. Some beneficiary's who are over 21 years of age can be considered minors for the purpose of obtaining a visa. They can subtract the time that the petition was waiting for approval from your age. If your adjusted age was less than 21 on the day the priority date became current then you qualify for the minor child visa. Otherwise, you qualify for the adult son or daughter visa. The difference determines how long you have to wait to get a visa.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

HOW LONG DOES IT TAKE FOR THEM TO REVIEW THIS ACT?

I don't have enough experience with specific cases to answer that question. I would think the determination should be pretty straightforward, and NVC should have all the information they need to make a determination.
