This may be in the wrong place, but does anyone know the correct procedure to marry a US citizen in scotland? Do we need to give notice in england before we go up to scotland to get married? I booked the appointment to give notice in Hull and the Registrar in Scotland. The registrar then sent me the m10 forms via email, asking for them at least 15 days before the wedding. Do i still need the appointment in Hull? Obviously because my fiancee is American we will need a Nominated office to deal with non EU citizens.

There is the "law of England and Wales" and the "law of Scotland". Very different law and jurisdictions

There is no such thing as UK law (equivalent to the Federal code in the USA)

Call the Scots and see what they require... use a sub-title phone (joke)

Seriously, Hull and Scotland are more different than Alaska and Florida - so do it all in one place.

Not a question about spousal visas moved to regional area.

You should be able to get answers in the regional section for region specific questions.

Well...you also have to remember that Scotland and England are different countries and used to have some differences in requirements for marriage. Here are some links which may (or may not!) be helpful:

I think you might need to do a bit of research, but hopefully this information will get you on the right track. My husband and I were married in the UK in January, but before we did so, we had to give notice. I (the USC) had to obtain a visitor's visa in order to enter the country to give notice and had to be in the country for a full seven days before we could give notice (meaning your arrival day doesn't count, so basically you have to wait until the 9th day to give notice). I know that Scotland is a bit different, but you may wish to also check out the information for the UK which can be found at http://www.direct.gov.uk/en/Governmentcitizensandrights/Registeringlifeevents/Marriagesandcivilpartnerships/DG_175717. The Scotland registrar site doesn't seem to address it, the M10 isn't very specific, and I would hate to see you get turned away at your appointment because your fiancee doesn't have the right visa. I would look at the UK Border Agency website http://www.ukba.homeoffice.gov.uk/visas-immigration/visiting/marriage-cp/ for more information about what visa your fiancee might need.

Might I recommend contacting the Manchester Registrar instead? Personally, we got incorrect information from the people at the Hull registry office regarding visa requirements, and the people in Manchester were very knowledgeable and helpful when we went for our appointment. I think they deal with a greater volume of foreign nationals, and I think they would also be able to confirm if you are able to give notice in England and get married in Scotland.

I know this doesn't exactly your question, but maybe this will give you some more places for information and perhaps some other VJ folks can offer their advice.

I am the USC and we wed on the Isle of Skye in Scotland. England has nothing to do with it. The USC needs to apply for a marriage visa which can be done online and then the British embassy directed me where to mail my passport in Washington DC. I was sent locally for fingerprints and photo. The passport was mailed back with the visa inside. There is no document showing no impedence in US but I got an exact divorce decree and they accepted that as proof. If neither of you has been married before there will not be a document from USC except for the visa.

My husband contacted the Registrar office, scheduled a date, obtained the forms and sent them back to the registrar who posted the intention to marry in the window of the Registrar office for 2 weeks prior to wedding.

I arrived a few days in advance of wedding and we met with the registrar. He asked us a few questions and showed us the room.

We were able to make all of the arrangements online or phone. The registrar provided copies of the marriage documents the day after ceremony. We got several originals as we needed for my new license and social security, passport and the visa for David to move here.

The process for the marriage was so much simpler than the process for having my husband move here.
