Hi all,

I am a newbie here and feel very lucky to have found this forum for discussing the CR1 visa. I have been married since Jan 2012 and my wife is a US citizen. Both me and my wife are currently working in India on Indian payroll. We havent started the process as we are a little clueless about how to go about it.

Our story - My wife and I met around Sept 2010 through some common friends. I showed interest but she took her time in judging me. We dated for about a year and a half. But we knew this was for real and we fell head over heels for each other... We got married in Jan 2012. My wife was working in US for 1.5 years from 2007-09, post that she has been in India for some personal reasons. My lucky stars that we met during her stay here and we both live pretty close by as well so dating was easy ;) We have been contemplating working in the US of A and making a life of our own there, for which obviously I need to go through the CR1 process. It seems a little daunting and we really have bare minimum guidance and we are kinda lost. Hence would really help if you guys could throw some light to us newbies!

Certain questions on the top of my head -

1. Does it matter that my wife (USC) is working in India currently and not US?

2. Her brother works in US so can he be the sponsor here for the I-864?

Awaiting your responses! And sorry if our questions are repetitive or lame :( If we could just talk to someone we had feel much better... We will call the Mumbai embassy too to find out some more details...

It matters in terms of how you will go about doing this. It does not affect her eligibility to petition.

2. Her brother works in US so can he be the sponsor here for the I-864?

Check with Mumbai. Back in 2004-5 they were very good about responding to emails and never picked up the phone. I don't know how things have changed but Mumbai will tell you what they're ok with.

1. Have you tried Direct Consular Filing? That may be what works best for US Citizens living abroad who want to petition their spouses. It may be quicker that IR1/CR1, however there are some requirements. There are more experienced members on this site who may be of better help or you can also ask in the India sub-forum on this website.

2. I would think so, since the I864 is for financial support when the beneficiary arrives in the US. Again, please wait till someone more versatile in these matters presents a more accurate picture.

AOS applied March 21, 2012. GC approved June 11, 2012 & received June 18, 2012.

Exactly three months from start to finish,no RFEs.

Day 01,March 21, 2012: Concurrent filing of I-130/AOS/EAD/AP to Chicago Lockbox

Day 02,March 22, 2012: Package delivered to Chicago Lockbox

Day 04,March 24, 2012: USCIS Acceptance Confirmation received through e-mail

Day 07,March 27, 2012: Checks cashed.

Day 13,April 02, 2012 : NOAs received for I-130,I-485,EAD/AP & Biometrics

Day 36,April 25, 2012 : Biometrics Completed at Elizabeth, NJ.

Day 45,May 04, 2012 : E-mail notification for interview received for June 11

Day 46,May 05, 2012 : Received hard copy of interview notice

Day 56,May 16, 2012 : EAD/AP Production e-mail

Day 64,May 24, 2012 : EAD/AP Card in hand

Day 83,June 11,2012 : Interview. Approved same day. Card production email.

Day 84,June 12,2012 : E-mail Notification registering PR status.

Day 87,June 15,2012 : USPS picks up GC from USCIS.

Day 88,June 16,2012 : Received two hard copy mails, approving I-130 & I-485

Day 90,June 18,2012 : 10-year GC in hand. End of GC journey, for now.

Thanks all for the info! Really appreciate...

Our first step is to fill out the I-130 and send it out to Delhi lockbox. Delhi embassy couldnt provide us much info and were instead redirecting us to the VFS helpline no. which we have spoken to several times but those guys are probably as informed as us or dont reveal much or maybe we arent asking the right questions.

Guys if you also have a clue on this - does it matter that we have been married under 6 months, our marriage would complete 6 months on 20th July! Should we still go ahead with the petition or wait post 20th July?

no.

it only matters if you have been married for more or less than two years on the day of visa issual

6 months is immaterial

Hi,

I myself am new here. Also am a us citizen. I believe that if your wife is a citizen here in the us she can petition for you under a spousal visa. As for her working abroad it shouldn't affect the petition provided she has some proof of residence in the US. She can be your sponsor also if she meets the income requirements.

I myself married my husband in Punjab, India and was able to register our marriage in state of Colorado tho our situation is differ from yours I have done some small research and have gotten some advice from friends.
