Hello...I want to know if its possible to petition my 2 over 21 yr old sons to come over here in the US while i'm holding a conditional Green card. Your information is highly appreciated...thanks...Good day!!

I did some searching, I believe the only conditions that are placed on you by the Conditional Green Card is that you are still in good standing with regards to your residency when it comes time to remove the conditions. It dose not prevent you from filing I-130's for your two sons.

According to USCIS Service center sites they are looking at petitions dated Feb 05 over 2 years, and this also depends on if there are available visas for them. So the sooner the better to file those petitions.

Just a clarification. An LPR is an LPR, conditional or not. Secondly, the 2 over 21 year old sons would have to be "unmarried" if you wished to petition them as an LPR.

Yes that is correct if they are married then they go to a lower order of preference, and the petition can only be filed after LPR becomes a Naturalized Citizen, in that case the USCIS indicates that they are looking at petitions filed April 01. 5+ years and then add the time it takes to naturalize.

So if they are married the wait will be much longer.

Your dates are all wrong.

I sort of assumed it was reference to a number of situations involving Phillipines especially where the petition has been for an unmarried child who the Consulate finds out to be married.

thank you for all your replies...My two sons ages 21 and 22 unmarried are in the Philippines. I just got my greencard,June 2006, thats why its conditional. I have to renew it on April 2008, to get the 10 yr Green card. I dont want to waste any time, cause it will take almost 10 yrs, (hope ita not) to process this petition....Hope to hear some more info that can help me...Have a nice day!

Yes you can apply for them.

Those currently receiving a visa number waited 10 years, how long it will be in the future is anybody's guess.

Plus say a year for processing.

Tell them you will file and then forget it, who knows what the situation will be then, they need to get on with their lives. They can make a descion as to what to do when the visa number is current.
