Police clearance... conflicting requirements?

Hello again everyone,

Yesterday we got an email that our application was approved (NOA2 woo hoo!) so I started doing some research for our next step. According to my reading, my fiancee will be having her interview at the Montreal consulate. On different web pages for the Montreal Consulate both refering to K1 visas, they links to two documents that have conflicting requirements for police clearances.

This link, page 2, step #4 states that she has to get a police clearance for any country she has lived in for more than 6 months:

But then this link, page 2, states that she has to get a clearance for any country she has lived in for more than one year:

So, I'm sort of confused... The reason I'm asking is that she lived in Qatar for less than one year and from what I'm reading, that place is notoriously difficult and long to get a police clearance. If the requirement is one year, then we're set. If it's the 6 month rule, then I'm afraid it will drag out our process further.

Does anyone have experience with this that could share their information with me?

1/7/12 - I-129F Sent to Dallas Lockbox

1/10/12 - Package delivered!

1/12/12 - Notice that package is being forwarded to Vermont Service Center

1/17/12 - NOA1 received!! Notice Date 01/11/2012

6/13/12 - NOA2 APPROVED! 5-months to the date of them receiving it.

6/21/12 - NVC Received (I think, I called on 22 early morning and it had an NVC case number already). Assigned an Abu Dhabi case number. Asked NVC what I needed to do to change consulates and followed the procedures exactly as they told me.

6/29/12 - NVC sent our case to the wrong consulate even though I followed every procedure to notify them of change-of-address

6/29/12 - Emailed both Abu Dhabi and Montreal to request transfer to the correct consulate (Montreal)

7/16/12 - Frustrated by no reply from Montreal, I contacted my local congressman asking for help

7/18/12 - Phone call from rep of the congressman offering me help, very nice people!

7/24/12 - Thanks to local congressman's help, Montreal officially requesting case from Abu Dhabi (one month delay but at least we're back on track)

8/06/12 - Abu Dhabi officially received request from Montreal

8/22/12 - Received Packet 3 email from Montreal. Started gathering final documents

9/14/12 - Received e-mail from Montreal to hold on to our Packet 3 because our case is being forward to Vancouver (GRRR!!!! MORE TIME! But lucky because we were sending packet 3 papers THAT NEXT DAY)

9/27/12 - Received packet 3 letter from Vancouver.

11/5/12 - Medical Interview (everything's ok, thank god)

11/20/12 - Interview appt at Vancouver Consulate - APPROVED!!!!!! THANK YOU GOD!

The requirement is 1 year for living in the foreign country and 6 month for current country where you are currently residing. If his country of nationality would be Quatar then you would need one, if not then you are good to go.

Read this carefully. "Police certificates from each country in which the applicant has resided for one year or longer. The certificate(s) must be issued within one year of the date of the visa appointment. NOTE: An applicant must present a police certificate from his/her country of current residence and country of nationality, if residence in such country exceeds 6 months"

That part I understand from the second link... however, look at the first link:

"Each visa applicant aged 16 years or older must submit a police certificate from every country where he/she resided for at least 6 months after the age of 16."

This conflicts with the second link from which you quoted. That's my confusion.

7/24/12 - Thanks to local congressman's help, Montreal officially requesting case from Abu Dhabi (one month delay but at least we're back on track)

8/06/12 - Abu Dhabi officially received request from Montreal

8/22/12 - Received Packet 3 email from Montreal. Started gathering final documents

9/14/12 - Received e-mail from Montreal to hold on to our Packet 3 because our case is being forward to Vancouver (GRRR!!!! MORE TIME! But lucky because we were sending packet 3 papers THAT NEXT DAY)

9/27/12 - Received packet 3 letter from Vancouver.

11/5/12 - Medical Interview (everything's ok, thank god)

11/20/12 - Interview appt at Vancouver Consulate - APPROVED!!!!!! THANK YOU GOD!

Why are you looking at Montreal's site for the embassy? you are going through the embassy in manila right?

for the K1 you need a police clearance for living in any other country for more than 6 months since 16..

only an NBI is needed for the philippines.

The one year requirement that you are reading about is for a CR-1/IR-1 visa

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

nevermind...I just read that you are doing the interview in Montreal...although for a fiancee visa I have seen it is 6 months for the police clearance. The second link tells you to check out packet 4. So the Qatar one will be needed if she was there over 6 months.

Thanks for the information, but I'm still confused because the one-year requirement link clearly shows K1 Visa at the top, not CR like you're referencing. Am I reading something incorrectly?

And no, I'm not filing in Manila because my fiance is currently living in Canada.

Yes it says same for London. I lived in Italy for 8 months and it definitely says on London website I'll need one for countries I've lived in over 12 months x it's confusing...

April 30th 2011 Met in Las Vegas, NV at Paris Resort and Casino

June 4th 2012 Mailed I-129F from Salt Lake City, UT to Dallas, TX

June 6th 2012 Received in Dallas

June 11th 2012 Text/E-mail of NOA1

June 14th 2012 Received hardcopy of NOA1

August 16th 2012 Received text/e-mail of NOA2

August 27th 2012 NVC received petition

Sep 3rd 2012 Received Packet 3 from London Embassy
