Howdy,

This is my first post here, though I've spent quite some time perusing the useful guides and getting our paperwork together. I'm a US citizen, and my wife is an Iranian citizen in the US on an F1 (student) visa. We married about a year ago, over a year after she arrived in the country. We are now preparing to do a concurrent filing of an I-130 and I-485 to start her AOS. I just wanted to see if anyone knew if there was any sort of special rigamarole or technicality that was going to get in the way because she's Iranian, and if anyone has any tips for getting through them as quick as possible.

It shouldn't be an issue on the US side. Traveling back to Iran might bring troubles, depending on your situation. There are some Iranian members you can ask about that. Good luck.

It shouldn't be an issue on the US side. Traveling back to Iran might bring troubles, depending on your situation. There are some Iranian members you can ask about that. Good luck.

How do you mean? Troubles entering Iran as a US resident, or troubles entering the US after visiting Iran? As it stands, her visa was single entry anyway (all the Iranian F1's are) so yeah, there's trouble already with that. She basically can't leave the country, or else she's locked out.

Well I don't know the specifics, but from what I understand, at least some US PR's have trouble going back to Iran, either they married the wrong person, or something else, but from what I understand, it can be troublesome for them to visit home.

Some individuals from that part of the world have to undergo background checks before they obtain nonimmigrant status, which can significantly delay the process. I am guessing that in your wife's case any such processing would have been done when she obtained an F-1. I can't imagine anything else that would hinder her adjustment.

Hi,

I don't have any specific experience regarding AOS and I am sure Iranians with experience in this regard can answer you more specifically; But by reading the discussion and the comments, I think I can say a few things that might be useful:

1. Your wife's background check: As grrrrreat said, all Iranians undergo several background checks when dealing with US immigration-related issues which potentially could take several months. Luckily in your case, your wife has already been checked once so this time it "should" be much easier.

2. If I understood it right, the issue that Harpa Timsah is talking about is that like some other countries (Germany, Austria,...) having dual citizenship (in your wife's case Iranian and soon-to-be American) is "illegal" according to Iranian Laws, whereas it is completely legal in US. The reason for quotations are that like many other laws in Iran (I'm sure your wife can tell you more about the Iranian laws :D), the officials don't bother to take action if someone has multiple citizenship. In other words, although they CAN cause you trouble, they are really nice regarding this particular law. My family and I and a lot of our friends and relatives have dual citizenship, but I have never had or heard of someone having any trouble when entering Iran or getting out. To sum up, although this is a law, but the officials are very understanding and know that it is a really common thing, so generally they don't want to cause troubles for their citizens in this regard. There are way more important issues in that country to be solved :( You can think of this as attaching a GPS unit to the front windshield of your car. Although it is illegal, but no one would stop and ticket you just for this. But when you do a serious thing like speeding or driving drunk, they simply add it to your fine. So don't worry and go on with her AOS ;)

there is no problem. I just wanted to get ur attention that after you file for her, don't let her to travel outside USA on her F1 visa, most likely she won't be admitted back to USA, wait till she receive her AP. also, u need to read a lot about the process so you know what to do.
