Interview next month, will they ask us about my out of status parents?

Hi all just got notice for interview next month! Excited but also worried since my parents are out of status AND live in the same city as we do... and I don't see how that won't come up at the interview...

Anyone know how to handle the topic of my parents being out of status? What should we say if we are asked about them? I'm really worried about that now...

March 2012 - Married <3

AOS Concurrent I-130, I-485, EAD
Day 0.....4/03/12 - Package mailed to Chicago via USPS Priority Mail 4/06/12 - Delivered!
Day 7.....4/10/12 - Email Acceptance Confirmation for all 3!
Day 13...4/16/12 - NOAs for I-130, I-485, EAD received in mail.
Day 16...4/19/12 - NOA for Biometrics appointment Received. Scheduled for 4/27/12.
Day 20...4/23/12 - Biometrics appointment completed, early walk-in at different location!
Day 66...6/07/12 - EAD Production!!! Lucky, 2 days before this we submitted a change of address from ND to PA
Day 70...6/11/12 - 2nd EAD Production 6/12/12 - EAD mailed! Interview scheduled for July 13th!
Day 73...6/14/12 - EAD in hand!
Day 82...6/23/12 - We mailed letter to old Office to confirm change of address and cancel our July 13th interview. Received NOA for an Interview scheduled in Philadelphia Office on July 24th!
Day 92...7/03/12 - July 24th interview was cancelled (file did not get in on time). Got NOA for interview on August 9th!
Day129..8/09/12 - INTERVIEW! Received card production email 8hrs later! 8/10/12 - Email NOAs, approved I-130 and I-485!
Day138..8/18/12 - GC DELIVERED!!! Emails received: 2nd card production email on 8/15, card mailed on 8/15, card picked up by USPS on 8/15.

12/13/12 - Filed for divorce 8/2/13 Entered Divorce Decree

They may ask, they may not ask. The only thing that you should say to the IO about them is the truth to whatever the questions he/she ask regarding them. Do not lie on their behalf.

-Dec 2006: Arrived with an F1 visa

-Dec 2007: Met USC.

-Dec 2009: Got Engaged.

-Jan 2010: Fell out of Status.

-Oct 2010: Married USC.

-Feb 2012: Filed I-130/AOS

I-130/AOS Timeline

Day 0: 02/25/12: Mailed concurrent I-130/AOS Package to the Chicago Lockbox

Day 2: 02/27/12: Package arrived at the Chicago Lockbox.

Day 5: 03/01/12: Email acceptance confirmation received for Forms: I-130, I-485 & I-765.

Day 13: 03/09/12: NOA1s received for Forms: I-130, I-485 & I-765. Biometrics letter also received and scheduled for March 27th.

Day 24: 03/20/12: Email notification for RFE.

Day 27: 03/23/12: Hardcopy RFE received in the mail.

Day 31: 03/27/12: Biometrics completed.

Day 40: 04/05/12: Mailed off the RFE.

Maybe the OP is worried about getting their parents into trouble with USCIS.

Maybe the OP is worried about getting their parents into trouble with USCIS.

Without sounding to be insensitive, but the OP's parents made their decision when they decided to over-stay and if anything should arise due to the interview, then unfortunately they will have to deal with the consequences of their actions.

To be frank, the USCIS and ICE already knew that the OP's parents overstayed when they failed to leave and if they didn't-- it certainly would have been brought to their attention when they started running the background checks and delving into the OP's case when the I-130/AOS package was submitted, so nothing will be a surprise for the IO on the date and adverse actions against them, if any, for coming on the radar would likely already be under-way regardless of what happens at the interview.

As the saying goes, your parents made their bed when they decided to overstay and they need to lay in it regardless of the consequences, there is no sense in the OP throwing away their future trying to lie for them, lies won't protect the parents at this point; lying will only result in a denial of your petition.

The only correct answers that you can give the IO, if asked about your parents, are the ones that result in the truth. Nobody here will tell you to lie under oath to a USCIS Officer.

OK lying was NEVER part of the question. I would not lie and certainly I would not expect anyone to suggest it.

Maybe a better way to ask would have been if ANYONE else was/is in the same situation and what has been the experience.

And FYI I would do anything for my parents, I would throw away my life for them in a heartbeat. Everything they did was for a reason.

I've never heard of anyone being asked about an out of status relative. I wouldn't lie if asked, but I certainly wouldn't volunteer info either. Chances are it won't come up :)

As a rule, the status of your parents should not be brought up in this interview. Officers are instructed not to stray out of what is pertinent to your situation and your case alone.

If the subject is brought up, you can always question its relevance to your process.

I have a brother who is out of status. I have two with green cards. My interview was very hostile but those particulars never arose. It was mostly focussed on me and my petition. If your parents are not in any initial or supporting evidence you present, IO has no reason to go there. IO in my case was very interested in who my sponsor was, how we met, how long we have known each other etc. My petition had a sole joint sponsor who is a longtime friend, a USC. Hopefully that gives you some comfort.

Exactly. If you say 'Well my out of status parents think he's great' you might have an issue. LOL! But how they feel about your SO has nothing at all to do with their own immigration status and so there is absolutely no reason to mention it.
