Case no not received/ BMB Case Number New Delhi & Mumbai

Hi

My Husband is a US Citizen and we Filed I-130 in New Delhi on March 5, 2012 for myself. We got an email from Delhi US Embassy on March 28th that my I-130 petition has been approved and to give them 2 to 3 weeks before we hear anything from Mumbai consulate. We have been following up with Mumbai Consulate via email where they don’t have any information about this we don’t even have a BMB case number? My question is how do we get this

Mumbai Consulate says it has not received anything from the Delhi Consulate, while Delhi is not responding to any of our e mails. it’s been more than 3 months where my husband is in US and I am in Mumbai….. both of us are perplexed as what to do next.

Would humbly request if any one can guide us here

I'm not able to understand your case.

Where did your husband file for I-130 ? Usually after the US citizen Spouse files for i-130 in US and once it is approved, the case is then forwarded to National Visa Centre. How can Delhi embassy send you a letter. ?

Based on your message, I think your husband has done DCF filing (which requires USC to live at least 6 months in India to be eligible for DCF filing for I-130 application). Correct?

If so, your application has skipped USCIS wait time and got approved quickly. I don't have DCF experience, but my 1st suggestion is to ask your husband to call NVC office in USA with your USCIS Receipt number (you should have this number written on your NOA2 letter), and also call USCIS to find out where your application is forwarded after the approval. US Embassies in India are always overwhelmed with lot of visa applications every day, so they may not give attention to any phone callers. Don't panic, you should be fine :thumbs:

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes you are right it is DCF filing since my husband was posted in India for more than a year with his work and it was suggested by our lawyer to file I-130 petition at Delhi USCIS which we did on 3rd March 2012, we also had a personal interview on the same day.

Smart84: We dont have any approval letter or NOA2 letter we were just given a general reciept for I-30 fees paid, plus we had received an email from CIS.NDI@uscis.dhs.gov on 28th March 2012 that our approved I-130 petition is being forwarded to Consular Section Am Consulate General, Mumbai. and to please allow their office about 2-3 weeks to receive and record the receipt of the documents and then we may email at infousdelhi@vfshelpline.com for further case status.

We have called Mumbai and emailed them but they ask for our case number or an approved letter which we dont have... Mumbai says we cant do anything till we hear from USCIS Delhi. And unfortunately Delhi is not responding from the last two months on the emails send by our lawyer which is really frustrating.

With regards to the NVC suggestion I have checked with my lawyer where he says that we cant call NVC as they handle only petition filed in the USA. By filing at Delhi, we are able to bypass this stage of the process.

So stuck sadly

when they issued general receipt with I-130 fees paid, was there a receipt number written on it? If so, have you tried to check on www.uscis.gov website?

FYI, NOA1 and NOA2 letters contain the same receipt number to track I-130 applications (track at www.uscis.gov) filed to USCIS Chicago lockbox in USA.

As expected consulate does not generate USCIS receipt number for DCF filers to track on www.uscis.gov site. For example, I filed for my wife in USA and we had tracking number starting with "WAC" because it was forwarded to USCIS office at California Service Center for I-130 processing.

It seems to me that you are in a deadlock situation where Mumbai consulate/VFS is saying nothing received from Delhi consulate and Delhi consulate is not responding to any communication requests.

I am not familiar with Delhi VFS office phone/fax communication, but have you tried to contact them over phone as well? If so, what was their response?

If you can't see anything moving from Delhi / Mumbai consulate over the phone/fax then my first advice is to make a trip to Delhi consulate and have face-to-face conversation to find out where your file is and mention them that Mumbai consulate does not have any paper work received from your office.

Try to be proactive rather than reactive. I suspect your case has gone in zombi state and needs some action from your side to get it back on track.

We did the same thing. Went to Delhi six months after our marriage as my husband was here on temp assignment as well. We filed the I30 and got the receipt just as you say. However, we filed in Delhi on 30th of April or thereabouts and got packet three from Mumbai by the end of may (May 30th if I remember right).

If your husband is not here and is in the U.S can he write to the consulate in Delhi and Mumbai under Citizen's services requesting for an update? I believe they pay more attention to citizen services queries.

I am not sure if you are currently in India, but if you are...What I suggest you do here is to keep calling VFS and mailing them once a week till they answer your question. I did this to have my interview re-scheduled. Was a painful process, was often stuck on the phone with them for 40 mins :(.They are pretty by the book but you have to keep calling and explaining your situation. In most cases they just forward your mail to the consulate and wait for a reply, so be persistent in explaining your situation.

@mysticlady: YEs i am in mumbai and have been calling VFS helpline where they tell to send an email to delhi. My husband has been directly calling nearly every day through the US Citizen services where now he has been asked to wait for 2 more days for a reply to his email to USCIS Delhi,they have asked to reach out to them again only if we dont hear anything. So we plan to wait for 2 more days.Hopeully we would hear some good news soon :-)

USCIS Delhi unfortunately does not have any contact numbers one can only reach them via email or fax only. Email Id: infousdelhi@vfshelpline.com;

CIS.NDI@dhs.gov Fax:(Country Code 91) + (City Code 11) + 2419-8730. Where we have sent emails and fax numerous times.

@Smart84 : Our lawyer says that USCIS will not allow me to enquire in person since I am not a US Citizen he has advised me not to write an email since i am the beneficiary so my Husband and my lawyer has been writing to them. But I intend to personally visit Mumbai Embassy tommorow and see if they can tell us where are file is

Mine came by post to my Mumbai address. Here is another suggestion, I don't know if you've tried writing to the consul general? - the e-mail id is given in the website. Explain the situation with thread mail attached so he knows you've done the foot work prior to approaching his/her office.

I met a guy at my interview today who was being given the run around for a F1 immigration visa saying his dad filed papers in 2008 and hence his case isn't current or some such thing. He mailed the consul general in mumbai and got a call from VFS the next week and they sorted his mess out and he attended the interview today.

Now they have shared packet 3 and case number on email, we have submitted DS-3032, Applicant Statement and DS-230-1. DS-230-2 to them and awaiting thier reply. Happy to see a revert after so much confusion and thankfully things have started moving in the right direction :-)

Yes have signed only DS-230 Part-I and left Part-II unsigned :) Mumbai Consulate has confirmed the receipt of packet3 nine days back

Any idea on how long does it usally take for them to revert back now ??
