not long after my wife got her green card she was gone havent heard or seen from her in 2 years i do know where she is dont have even a phone number for her.I her all the best im in no way trying to get back at her but my question is is is ok that i never let anyone in the govt know she left I dont want anyone accusing me of scamming with her.I guess i should of known better but thats water under the bridge.about 1 year ago a lawyer called me asked me if i could give him some tax papers that i might of filed with her i hung up on him dont know what hes looking for.am i ok for just going on with my life or can this come back and huant me. i live on ss very little assets so im not worried about passing away and her trying to get anything anyway how would she know i died.IS there something i need to do to protect myself?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

engineer21 nailed it. Your wife is trying to remove conditions on her green card. When someone gets a green card through marriage to a US citizen their green card is conditional for two years. They have to apply to have those conditions removed within 90 days before the green card expires. That application is normally filed by both the green card spouse and the US citizen spouse. If the marriage ends in divorce then the green card spouse can apply on their own, but they need to prove they entered the marriage in good faith. An important type of evidence is proof of co-mingled finances, which is why the attorney asked for a joint tax return. The truth is that he doesn't really need your cooperation to get that. If you filed a joint tax return with your wife then she could get a transcript of that return from the IRS.

You aren't required to notify the US government that you split up. She'll do that when she applies for her 10 year green card. If you didn't seek a divorce then don't be surprised to find out that she did. She'll need the divorce decree in order to get a 10 year green card.

You're still on the hook for the affidavit of support you signed. That won't expire unless she becomes a US citizen or works for 10 years. It's unlikely it will ever cost you any money, but you do have an obligation to report your address to USCIS if you move.

You can't have a wife running around out there that you aren't really married to. If you can re-locate her attorney then you can contact her through him and get a dissolution going. Otherwise you are looking at doing a divorce in absentia, and they'll have you publish notice in a newspaper of record about the case to show you tried to notify her. It is a little more complicated than a co-operative dissolution but you can do it.

Wouldn't it be easier to tell the USCIS what happened? If she gets deported then good. She toyed with you and cost you thousands of dollars already. Besides she is doing a disservice to us all by abusing the system like she did.
