hello im spouse of a permanent resident he filled for me f2a visa my folder now is in the nvc center waiting my case to ecame current my question is that my husband when he filled tax of 2011 he joined me in april 2012 my social security was refused and he applied for ITIN

IRS told him to wait betwin 8 to 10 weeks my question if that ITIN refused that will cause delay of our tax ?

i need this tax in the day of interview they will ask me of tax of my husband he must pay tree tax return

this ITIN has relation with process if they refuse it can process of tax complete withaout that number i don t live now in usa im in my original country

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

hello i my social security was refused by IRS because i still in my original country my husband joined me in his tax return of 2011 he apply now for ITIN i want to know if this ITIN refused IRS can complete process withaout this number????

because IRS ask him after refusal of social security number for ITIN

my visa interview will be in december 2012 and irs didn t approuve tax of 2011 because of this number

can this number delay proccess of tax

If he applied for your ITIN it takes 4-6 weeks to get the number he can file the taxes and have no issues by Dec. How do you know if they will not reject the request? The social security office will not accept the request if any requirement is not met. So if they accept the request then you will be issued an ITIN. The ITIN is designed for people who do not yet qualify for a SSN but need to fill taxes.

You all should not have a problem....

First of all, it is not necessary to include spouse ((who lives in abroad) of LPR in tax returns. Most people do include for two obvious reasons-1. joint filing is beneficial and 2. can be seen as evidence as couples still married during visa interview.

I understand you must have filed for extension for 2011. Send paper based tax return to IRS along with application form for ITIN and photocopy of your spouse's biographic page of passport. THERE IS NO WAY That IRS REJECTS unless THERE IS SPECIFIC Reason to reject.

I did apply for ITIN last year for my spouse and we were provided ITIn within 4 weeks (even during peak tax filing season).

thank u so much for your replay i want just to know if IRS refused my ITIN of any reason can process of tax continue withaout this number??? i must get it in the end of july 2012 and my interview will be probabely in the end of this year if they didn t accept my ITIN the tax will be approuved withaout him???

i suggest that your husband file a new PAPER return for 'that tax year' and include a W-7 form WITH the tax form. Since they rejected what he's filed already, it won't be an amended return (1040X)

Prep yer ID docs for the W-7 nowish.

The two of you, please study the instructions with the W-7.

Since it's no longer tax season, expect longer processing time for all of this stuff, as the head count at the IRS Office in Austin (that handles W-7 intakes) is much less now, than when 'Tax Season' was going on.

i think you'll be ok on time and timing .

IF yer PD is current at NVC, there's still between 2 to 3 months of stuff yet to do at NVC, minimal time.

If he'd like to include the IRS Tax Transcripts and ITIN formletter with the DS-230, he has up to 1 year to file the DS-230 at NVC.

I think you'll be OK on time, no reason to rush when getting the tax stuff done properly is as important as filing the DS-230.

So, slow down a bit at NVC, but make certain yer spouse in the USA has all he needs for the W-7 form, from you.

THANK U FOR YOUR REPLAY IRS told him that is too late to fill another application and separate our forms

they advice him to wait until ITIN be accepted after that they will continiue process of tax

well, you can listen to the IRS, or you can listen to me.

You choose.

I filed a regular 1040 with an ITIN application from my wife, for Tax Year 2010 in December 2011, all to the special IRS address listed in the W-7 form.

Since your husband's return was rejected, you have a new chance to get it all done right this time.

The two of you need to sign the tax return, include a letter asking the IRS that you be considered a resident alien for tax purposes (from the both of you, signed by the two of you) , and include the w-7 form with the proper identification .

Yes, they can and will. It will get processed for filing status 'whatever the IRS agent chooses' and the extra tax benefit of 'married filing jointly' will be reduced, as that filing type won't be available at the time the Agent redoes the math.

Your name won't be anywhere in the stored IRS tax transcript.

thank u so much for i have just a question in the day of the enterview consular officer will check my last tree tax return to give me a visa it s important i want just to know if my ITIN refused and i don t have ssc my tax will not change and ill have no problem when they will check statut of my husband?
