Hi,

I haven't been here in a long time. After using the K-1 to get my fiancé here years ago I have returned for help and guidance for the process of helping my mother-in-law immigrate. Actually, she doesn't want to immigrate, but just visit. However, the US gov't has denied her a visitor's visa. Reason: unexplained, but she didn't ask either.

Anyhow, I could make a short story very long so I'll cut to the chase.

My husband is gathering the materials and the information to submit the I-130 so he can petition for his mother. He is a USC now. I see that the mailing procedures have changes as of Jan 1, 2012. According to the changes we mail the documents to a Phoenix PO Box. Fine. Will do. However, I can't seem to figure out what happens from there. He keeps pestering me to find out the processing time for this petition but I don't know where to look. We live in Tampa, FL. The TSC handled our K-1 petition so I would imagine they would also handle this, but I can't find this information.

Enlightenment and links are appreciated. I've read some of the guides provided but I don't see this topic addressed.

The processing time for the petitions have not changed much but that is not the main issue. Once the petition is approved, she will have to wait until a visa is available and that may take years for there are quotas allocated each year for the different categories and the IR-5 are in the back of the IRs.

IMHO it might help her if she scheduled another interview at the consulate and found out why her visa was denied. As you say the reason was unexplained you may be under the assumption it was because use she has family in the US, however you will never know if she does not try again.

The same conditions will apply, regardless of having family here, in that she will need to prove she has enough ties with her home country to convince the officer she will return.

It will not hurt her a bit giving it another try.

The above post is incorrect.

IR-5 petitions are usually processed by the service centers in about 5 months, transferred to the NVC, then to the consulate of the country where his mother resides. The entire process usually takes 10-11 months from the time the I-130 is submitted.

The initial petition requires the I-130, the USC's birth certificate showing his mother's name (with translation if necessary), the USC's naturalization certificate, and if he changed his name, the documentation for that.

That's great news. It was about time they crunched the times for some of the IR categories! Thanks for the heads up!

They didn't crunched anything is simply that for a parent of a USC there is no waiting line for a visa that is why IR stand for!

Thank you for this info. I appreciate it as I couldn't find anything quite as concise anywhere. He mailed off the I-130 this morning but he didn't realize a copy of -her- birth certificate was necessary. He included -his-. So, I guess they will be sending him a request for more info. Too bad. I didn't double check him because I want him to do some of his own work on this.

No, he had it right. Her birth certificate is not necessary at this time. As long as her name is on HIS birth certificate, that's what they want at this time. They won't likely ask for her birth certificate until the interview.
